I'm getting very confuse here , What's the difference between Firmware and Software Version ? I see a lot of 3.0.1 , 3.1.2 , What are those ? Well the simple thing is that firmware/software is the same. Ok currently right now, 3.1.2 is the latest firmware that apple has to offer their iphone/ipod touch users. This can be downloaded off Itunes to enhance the device. 3.0.1 is the apples minor update to its 3.0 firmware that's about it. 3.1.2 is apple's latest firmware which they just released on the 8th with some bug fixes to rectify their 3.1 firmware.
To find what firmware you are, open your settings, go to general, click on about and look at the firmware. If you are currently on 3.0/3.0.1 you can jailbreak the device, there are posts on this thread how to do so.
If your phone is at 3.1, then at this point you can't jailbreak it as there is no tool to allow that at this moment (maybe in a few more days)

No that means you are only on 3.1 and not 3.1.2
Right now you can't jailbreak your device because its at that particular firmware, you would need to wait for a program called Blackra1n, when it's released, you should have no problem jailbreaking your phone. If you want to be sure your on 3.1, then just plug your iphone into your comp and start itunes, it will inform you if you are there is an update to 3.1.2, simple
