They are only trying to scare you when they say you won't get a cent back. Because it is up to the judge whether or not you get the money back. Could be full, could be 50%.

On that day, they claim I sign at my own will also. I said, I signed it knowing that I might get the Jade Mattress, but I didn't know it was a scam. I told the judge that, if this mattress was part of a scam, it doesn't matter if the market price is RM10000, I still can't sell it.

In the end, the judge gave orders that I return them the mattress, and they refund me RM1100, instead of RM1200 which I lost.

the guy called william actually had the balls to show up in court. i did not get full compensation. the outcome of the settlement - 80% of my money back was determined not by the judge, but by william and i, outside the court. i'm glad that the remaining 20% was kept by him in the form of cuts and bruises a few days later. i wanna thank the guys who beat him up with style.

sorry to say this, but i doubt you will get full compensation. reason being? 1. you yourself as a consumer have to shoulder part of the blame, and 2. the company needs to cover some "costs".

a lady had her hearing before mine, and the judge didn't award full RM1200 compensation to her because RM200 had to be "kept" by the company to pay for their "admin cost". total bullsh*t, i know. she only got RM1000 back. the judge also pointed out that the company's technique of giving out flyers and inviting people to participate in the lucky draw is called, marketing. double-you-tea-eff.

my suggestion to you is to argue your case from the stand of a dissatisfied consumer, instead of a scam victim. believe me, the judge who handled my case had seen too many scam cases like ours. he did not read my police report before the court hearing. so be prepared that the judge who handles your case will show you little consideration/sympathy.

look inside the mattress and see if you can find warranty letters/user manuals. what you should look for is if there are any SIRIM or Jabaatan Bekalan Elektrik labels that certifies the quality and safety of the mattress. coz if it doesn't have any stickers/labels that endorses the usability of that mattress, from the perspective of a consumer you can say you fear for your safety. bla bla bla. you might wanna do a bit of research on which ministry does all the QC and safety stuff though. i did not think of checking the mattress i got last time, and i'm not sure if it has any quality labels on it, so i'm suggesting it to you now, and i hope it is a valid point for your argument.

How are you being scammed? Did they tell you that you've won the 4 products? Or did they sell you the products for RM4k? 

Even if you don't have any receipt, you better hope Starr Healthcare has the copy of your signature on the contract. So that is a proof of purchase. You can probably argue that they didn't send the products as they promised.

If you were scammed that you've won, what I told the court was that I signed the documents because I thought I am able to sell the product. But because the product is below the standard that they proclaim they are - ("Very Good Japanese Brand - Kochima"), so I am not able to sell and want a refund. I told the judge "it is similar to trying to sell a stolen car".

Er... Maybe can gua. I'm not the judge, and not a lawyer... that day was the 1st time I attend court oso. 
I guess its a viable point. Saying that after checking online then only you know the company has bad reputation, and you regret buying from them. Since you didn't receive any products yet, you want a full refund.

But I think the chances of winning is not high, because you bought the stuff. Unless after using then you know is bad product (i.e. spoiled after a week) then maybe you can ask for refund. But without using it yet, there is no issue to argue.

Don't believe their shit... They only scaring you so that you might negotiate with them and settle out of court for half the money. With so many cases, I think the judge should have already know who is the good guys and who is the bad...

I was one of the victim too. and the worst thing is I don't have saksi and any black and white proof. And my court is at 29 of Sept. How? Can I actually win the case?

Finally i get back my money 1900 of 2000 from them today.

If u r a victim, pls read my story abt wat i done to get back my money.........

1. At tat day being cheated, i go to do a police report. Actually police didnt help at all.

2. After tat, i go to fail my case at TTPM (Tribunal Tuntutan Pengguna Malaysia). I fail at seremban branch near my place.

3. I pos the borang 1 to the company address. I duno the company address, so i go to SSM (Suruhanjaya Syarikat Malaysia) to get Starr Healthcare (m) Sdn. Bhd. address. I u didnt receive ur A.R card, pls process to Pos Office to ask abt the A.R card. U need to A.R card to attend the listening.

4. At the listening court they didnt appear,but i cannot prove tat i hd pay Rm2000 to them as i didnt hv the resit. Luckily i hd a saksi tat oso with me when i being cheated tat can prove abt i hv pay to them. the judge finally approved the award to me as they have to pay me RM2000 and i have to give back their things after receive the money.

5. I pos oso the award to them, but after 1 week, i didnt receive any feedback from them. then i call their company director Mr Gan (019-7119119) to deal with him. as the beginning, he said jz can paid back me RM1800, after i force him, he promise to pay me RM1900. Then i jz accept. (Try to deal with him nicely, he is very easy to become angry, he is ok when he is not angry.)

6. He say have to pay me via cheque, i didnt believe the check coz i scare it will bounce. Then i jz ready a surat pengakuan terima barangan before i go to his office at Taman danau desa. I ask him to sign a letter 1st be4 i gv the things to them. He also hv a piece of paper stated he oredi receive me the things and hd pay me a cheque tat stated the cheque num, amount and etc.

7. After i get the cheque, i deposit it immediately around 2pm, after 1 and half day, the night of the nx day of deposit date. i receive the payment (today). tat all.

Finally i hope u guys can get back ur moey even tat not the full amount of money tat we hd paid.

im also dont have the receipt with me. i call mr tan and ask him to gv me the receipt. he told that his company already post it to my house according to the address in my ic. 1st i dont believe him, and i fight with him in the phone and i frighten him that i will find him if i not receive my receipt yet. finally, they had sent me the receipt. but that after i file the report to the tribunal. dont worry too much if u dont have the receipt. the judge didnt ask me about that receipt in my court hearing and i won the case liao. now im just waiting for them to pay back my money.

I am one of the victim of this scam too. I filed a claim to Tribunal for Consumer Claims on 10/9/2009, my hearing date will be 9/10/2009.
I tried to sent the forms to Starr Healthcare (M) Sdn Bhd located in Kuchai Lama using Pos Daftar but they refuse to receive the letter. Today I just taken back the letter from Post Office. Can they simply say that they don't know about the court hearing and then just ignore it?
Any suggestion?

Mr Tan just called me asking if I want to settle it outside the court, he can pay me back RM400 (cash). I gave him RM500 cash that day. He say balance RM100 will be deducted as their processing fee.
He says if I lose the case, I won't get a single cent. He also says that even if I won the case, I only can get back a cheque after November. Is it true?
Since he don't have a legal license, how much is my winning chance? Will I be so unfortunate to lose at the court?
