If i buy a locked Iphone 3G and use yellowsn0w to unlock, can I still use it under Maxis and their data plan?

So how come people just dont buy one from Ebay and unlock it and use it under Maxis, instead of signing up their plan and pay so much for the phone?
Is the warranty worth it? |
