My humble opinion is that we work towards obtaining our CF, then form a committee to represent us...Do not rush...

I agree with Nuwaira... not only we are exposing ourselves to lawsuits but this will also have impact on the value of the house in future (if anyone decides to sell the house later!). When we bought the house, we all aware of the risk of buying a house under construction. So, we need to think twice what we post here. Its quite disturbing to think what the issues re CF - is this normal OR 'are' there major problems, if so, what are they and what can we do to protect our interesT

LET'S RESOLVE THIS ISSUE IN AMICABLE WAY

Hello everybody,

I spoke to Encik Affendi to ask about the form.

He said, we need to give him a copy of the S&P and the Deed Mutual Covenant. So, those whose S&P exceeded 3 months can go lah. They need our details and yes, can send representative (only PH1 owners lah in this case). Once we bring this matter up (issue should be CF not defects) to the lembaga, they will first check with MPS and Pemaju, It usually takes about one month for them to revert back to us. He said delay could be for various reason, e.g. 'pindaan' or the Pemaju didn't pay certain cukai. If this can't be resolved, only then we can request for the meeting with the relevant authorities.

So, what's our next course of action. 2/3 to represent those who have received the keys and S&P exceeded 3months?

Hello everybody... AmanSiara is getting very buzzzy already! ;o)

I'm sure many of you may be sourcing out for contractors to renovate the kitchen - good to share info re layout & cost... I saw the showroom (MEGO), they hack the wall and changed the window- I don't think this is permitted.

Fyi, I went to shop for hood & hob at this shop called LEGEND - warehouse sale. Quite reasonable - you can get hood & hob for RM1288 (brand - Rubine). Together with oven RM2888. Got few brands, Fagor, Elba, Fotile - but some brand may not be suitable to asian style of cooking. Fotile must do ducting - anybody doing ducting?

Anyway, I gave the layout to the sales person and she will do the costing - if the whole package is expensive, I might just get the hood & hod + sink. You can also pay but ask them to keep if your house is not ready.

Hyeee....

I've called Wirama (spoke to Jasmine) re the settlement of maintenance fees and etc (RM1059.65). However, I was informed that I should wait for the Bank to disburse the remaining 17.5% to the developer. We will be notified (as usual with the green receipt).

biggrin.gif No need to settle until until the bank release the last payment. You will be notified by the bank not Wirama. I know, very confusin because the letter says to settle that $$$ within 14 days.

I took the loan from OCBC, so each an everytime back release money (drawdown payment) to Wirama, we will get a copy. Not sure about other banks though.

I've also called the bank to ask if they have released that 17.5%, they said no. Once Wirama issue the bill, the bank will take 4 working days to settle.

1. the clause "..... within 14 days from the date hereof, failing which you shall deemed to have  take vacant possession..." (standard clause of HDA)
this mean that your VP will be either u have collected the keys by 14 days from the letter date OR letter date +14 days even u have not collect the keys, whichever is earlier.  Ur defect liability period of 18mths will take effect from ur VP Date.
Ex: VP letter date : 1/12/09.  If u collect keys on 10/12/09, then VP= 10/12/09.  If you collect keys on 30/12/09, then VP= 14/12/09. 

2. VP vs CFO
VP letter not CFO.  But usually when developer submit borang E and authority has received it, then they can send VP.  Normally authority will take 2 weeks to issue out the CFO (in normal practice except special condition). Without CFO, renovation or moving in cannot be carried out, just can collect keys.

3. Collection of Keys
subject to full settlement of all outstanding including of progressive payment and misc charges.  Thus cash purchaser, made full payment and then can made arrangement to collect keys.  For loan purchaser, wait until reimbursement from end-financier, then only pay the misc and made appointment to collect keys; or else oso can pay misc charges first, up to you.  Interest issue, purchaser need to bear even is bank fault, unless bank willing to pay the interest, or else ask developer to waive it.

4. Defect liability Period
upon collection of keys, must do the defect prior to renovation, to avoid any dispute and arguement on defect liability list.

[I]ya, the final 2.5% from the purchase price will only be billed by the developer to us or bank UPON THEIR SUBMISSION OF THE SUB-DIVISION OF THE SAID BUILDING = TO CHANGE THE MASTER TITLE TO STRATA TITLE.  on VP Stage, in total developer only will claim 97.5% from us.  nod.gif
