Hi Kelvin and all,

If CF has been issued, I don't think we have negotiating power (my opinion) unless developer shows some effort for a win-win situation that can convince us. Else Mr. Developer might says: "CF already been issue, meaning approve by authority that the house is fit to stay, what else you want to complain?" What we can do by then?

Hi Mr. Developer, (if you are viewing this forum)

If you are confident to deliver the rectification after we get the CF, might as well do it before... If every of our reasonable complain can be fixed, we don't mind wait for another month or two (I believe all owners can tolerate with the duration, if the problem can be rectified. Don't you agree owners? Rather than things not rectify or keep on dragging of CF approval).

You should ensure that you obtain the sub-certificate of the Master Policy issued by the insurance company from the MC and present it to the financial institution. In such a case, you will be required to assign your rights under the policy to the financial institution.

Q1: I have been informed that the fire insurance taken by the Management Corporation is compulsory. At the same time, the bank where I took a housing loan for the unit of condominium I have purchased also requested me to pay for fire insurance policy which has been arranged by the bank. Do I need two insurance policies ?

A1: Under the Strata Titles Act, it is mandatory for the Management Corporation (MC) of buildings such as apartments and condominiums to purchase fire insurance for the whole building. The individual unit owner is required to pay to the MC his respective premium portion. If the unit is purchased through a loan, the financiers would also normally require the borrower to obtain an insurance policy for the unit. There is the possibility of a situation of double insurance under these circumstances.

However, if you have obtained the loan from a bank or finance company under the supervision of Bank Negara Malaysia (BNM), it has been agreed that borrowers will not be required to buy another insurance policy for their unit. Instead, these financial institutions will accept the insurance policy already purchased by the MC subject to certain terms and conditions. If your loan is not from a lending institution under the supervision of BNM, you will need to negotiate the insurance arrangements with the lending institution concerned.

Hi Guys, my SnP dated April 2007, so after April 2010 only can claim LAD rite? The delivery is 3 years instead of 2 years, am I rite?

Dear Neighbours,

I've got the VP today. Someone can clear my doubts:

1. What does the following clause means:

(b) Certificate of Fitness For Occupation (CFO)
(ii) you shall be deemed to have taken possession of the same, upon the expiry of fourteen (14) days from the date hereof and we shall not be liable for any damage of loss of the said Property and/or fittings therein.
***********************************

So now I have to settle the amount of RM 1084.47 (within 14 days ??) before can arrange to collect the key for performing the defect checking? And normally how long period for us to check the defect?

2. Why I was charged interest for late payment? Isn't the financier shall ensure this payment on time.

3. The address on the VP shown SELAYANG still? Is this the same things happen to Phase 1 where address on VP shows SELAYANG but instead should be RAWANG?

4. Shall we pay the maintenance fee (12 months + 1 month advance) as it did not mention we get the 2nd year maintenance fee for free??

5. Any idea why the fire insurance are from (25-11-2009 - 10/11/2010) and not a full 1 year validity?


Appreciate members' help to advise the procedure. Am currently working outstation and would be much helpful with your advise so I can estimate and arrange my schedule to back to KL to settle the above.

Yes I got charged RM 19.71 for the late payment on the bill for early last year leh FEB 2008. How come now only bill me? I just concern that they might bill me for some late payment after we have been staying for N years later...

I took the loan from OCBC, so each an everytime back release money (drawdown payment) to Wirama, we will get a copy. Not sure about other banks though.

I've also called the bank to ask if they have released that 17.5%, they said no.  Once Wirama issue the bill, the bank will take 4 working days to settle.

Hi Susakthy,

My own record I have only paid up to 80% till I received the VP. Meaning after the bank release the 17.5% we still have another 2.5% to be paid to developer by the bank.
