Yup, thats a very common problem. Some said the upcoming v11 firmware will fix this problem while others mentioned it has not resolve the issue. Some people said it is a hardware issue in which they sent in to Nokia service centre for speaker replacement. Those service centers replace the speaker because they follow standard procedures. They won't spend time finding the cause, they just do replacements.
Just wait for the firmware for more confirmation. The current solution is NOT press the phone to your ear. Try spacing/easing it a little bit. Apparently it'll help resolve the issue. Probably the (just probably) the proximity sensor interfering with the speaker. Or just use a bluetooth headset for now.

You won't be able to tell. Because we can't tell how many units in a batch or each batch has different quantities due to yield. The serial numbers are all in sequence. Then supply chain management has made it very transparent to consumers.
You could check the production date (if this information is available). You could however wait many months from now, those early batches will be diluted from the market leaving the later batches in circulation. Just get an original phone. Save you from headaches. Any problem, Nokia will cover your repairs.
