Hello guys. I would like to seek some advice on the matter of resignation.

I'm still on probation and in my offer letter, it is stated that should I resign, I will need to either serve one month notice or pay in lieu one month's salary.

My question is, can my employer's deny me or reject my resignation? I have heard stories whereby a manager purposely delays approving your resignation. Do they have the legal right to do so? Assuming I give up a month's salary instead of serving notice.

Hi,

How long have u been working? You mentioned that you are still under probation period.

Employer cannot reject your resignation because in your offer letter, it has stated clearly that either you serve one month notice or pay in lieu of one month salary.

Usually manager will hold on ur resignation letter due to the short notice of your resignation while he couldn't find replacement / he needs you to have a complete transition to your colleagues. Of course, if he needs you to serve longer period, he should discuss with you. However, no matter how long he hold / delay approving your resignation, ur notice period start counting from the day you tender. Unless both parties agreed to postpone your last service day.

hi, have you got your answer? im facing the same situation with you... i just started work 3 days & i just got a better offer & i just tender with 1 month notice. My employee handbook did state clearly if a staff absent witout notice for 3 days continuous, will be deemed to have terminated the service... i wish to leave soonest possible by not serving 1 month..
shall i? can i?
what action they will take to me? send letter to my hse few times... if i still dint respond will they give up?

Huray...i have tendered my resignation but been asked to serve three months notice as stated on contract.

During this three month, can i take leave?
