I want to ask forumers' opininon here, here's what happened to me.

I was chased out from my working place by my store manager, he's stated "to not coming back at all after I stepped out of the workplace", Is that the same as fired?

Then, I ask my HR, what to do, since I still want to work. He told me to go back working as usual even though everyone 'pulau' me there. Yes, I'm going back to work as usual and yes, everyone 'pulau' me already. My store manager of course doesn't even look at my face at all. He already issued a warning letter for small fault that i did. Actually, I found all his accusations in the letter is truly ridiculous coz he actually let other workers to do it but not me, yet issued me a warning letter. He didn't give me the letter yet, but he already handed it to HR.

Now, the HR is handling my case. I already requested to be transfered to other store, I'm not sure it's approved or not. The worst thing could happen to me is when the warning letter issued, I'll lose all the benefits included annual bonus, shrinkage bonus and incentives for a year which is a lot and costs me a very big loss.

Now, I'm stuck. If I left my job, it'll be very hard for me to get a new job since my record is now bad due to the f*ckin letter. I can't find a new job yet, and I'm sure words and rumours are spreading around about me, and I think the new place is most likely to be the same as my previous one since I was given the 'letter'.

I want to know, what should I do now? what should I do if all my bonuses taken back for a year (it's a big amount though)? How do I fight back in this matter?

ninja88, if you are genuinely innocent, the scenario above can be treated as constructive dismissal. you can just put a letter to your superior & hr stating that you treat this act upon you as constructive dismissal and then go and lodge a report with Industrial Relations Dept for CD. compensation up to 24months.
but of course, this is a long process, and please tackle the root cause of such treatment.
it cannot be the whole department is boycotting you for no reason right?

Hmm, okay faceless. First time resigning, don't know much about it altho did my research.

Btw, regarding the payback in lieu, THAT should be agreed upon first or can I just write and payback in cheque/cash promptly like the resignation letter.

GK, resignation is the RIGHT of an employee. Hence, you don't need an approval from your employer to resign. Just serve the notice as stated in the appointment letter, or pay back salary in lieu.
End of story.

Hi guys I'm currently working with a local chinaman company in medical supplier biz as sales exec..an MNC Pharma company approached me with better offer, doubling my salary and willing to buy me out.

However I have to pay my 3 months notice and 2 years training bond which comes to RM9000 first before the MNC will reimburse me.

My question is do I need to state this payment in lieu of notice in my resignation letter and how do I make payment? The MNC also asked for receipt and release letter before I can start work there.

Another problem is how to make payment since I don't have a current account and cannot write cheque.

Sorry I have very little knowledge on resignation since this is only my second time resigning and first one I served the notice period.

Bl@ze, you can request your new employer to pay directly to your current company. Request a letter from your current company stating the amount which you owe the company and need to pay back. Send this letter to the new company and request the new company to issue cheque directly to the current company.
of course, this is a suggestion, and it's up to the budi bicara of the new company.
