First of all, there's no such thing as an OEM set, or AP even, for the iPhone.
In other words, there is only 1 iPhone, which is the one from Apple. Hence if the person sold you a phone from another manufacturer and claims that its an iPhone, then you may have a case.
They may claim that you need to install iTunes later on, but there's still no way that you can get any non Apple products to sync with iTunes for either music or apps anyways. This is another point to your advantage.
Which is also another reason why you should go to an authorized distributor too.

If it states iPhone 3GS, then it means that they've lied to you. It does not matter what the phone says, or what the box says, or what the manufacturer or the retailer states. As long as its not a phone that is made by Apple, then they have lied to you. And the question on how to differentiate the authentic products is also something that had been covered on here quite a number of times. Basically the failsafe method is to plug it into a computer with iTunes installed. If iTunes does not detect the phone or iPod, then either the device is faulty or the device is a fake.

Make sure you file the claim against the right party. I'm not sure who this W&N Event is (google does not turn up any relevant results), but if its a Mobile Fair organized by them, then chances are that the ones who sold you the phone is not the organizer, but some other company who had participated in the fair. Check the receipt for the actual party who sold the phone to you. This tends to be how such events work, where there's the organizer, and then the companies that takes part in the event setting up their booths. You can try making a separate complain to W&N as well about somebody in the fair they organized selling fake products and see how they respond.
