Like Cerebralrogue said, exchanged 3ROD console are tied to GT & console ID. So it doesn't make sense for a refurbish unit to get ban, there is a record for it. Whenever MS drop their banhammer, there are sure some user screaming "innocent" on the board...Internet story is as real as it gets.

Until the few local genuine player suffer the same consequences (3rod rate is high and piracy is higher in Asia), it's safe to assume random banning on unmod console does not happen.

I thought MS are fully aware of the design problem and went ahead anyway with the console launching because they wana be the first? Didn't the guy who leak this news got fired...?
