What if the merchant is declaring more than what I paid? Apparently just clarified with my merchant that he has declared on the declaration form outside the parcel based on RRP and not the discounted price...

Yes, you're right about Pos Malaysia & Pos Laju. My assuming is both is gorv. body so they just close one eyes to the others. But not all, as few shipment thru POS Malaysia/Laju also got taxed.
Declaration value take from what stated in shipping invoice or Air Way Bill / Consignment Note. I think your seller put the pre-discount price.

Also, since typically things below RM500 will not be taxed, is this based on custom own exchange rate or based on what is being reflected on our credit card statement?

I just paid RM110 to DHL Express with GST being half of it.

My total purchase item is less than RM500. If 6% GST is charged on my items, my total purchase must be >RM900 but that's not the case.

Am I missing something here?

Got K1 Form copy? The calculation is there...

Nope. Wanted to look at it also. It wasn't provided with the box. Do you think I should call and ask DHL?

Yes. It's your rights as importer to get the original copy of K1 Form including COR (Customs Official Receipt)...

Just got the K1 form from DHL. To my horror the custom has charged me $100 additional for shipping. My merchant gave me free shipping for spending above $100. I'm not sure who to complain now and what options do I have? I don't think I will have a case with custom, DHL will claim they are just the middle person and merchant will claim it's my custom's problem.

I believe it's correct. Read my several post above to understanding duties/GST calculation.

Well, I purchased from the same merchant a month back and they charged me $8 for shipping. Custom followed the same rate in the K1 form and came to the conclusion that everything inclusive of shipping is <RM500 therefore no tax.

I believe because this time it's free shipping therefore customs used their own calculation to charge on the shipping.

Just to share on my previous purchase.

Invoice from merchant.

K1 form from Custom.

As I said earlier Custom used the same freight rate declared by the merchant.

did your shipper put the shipping charges in the invoice for this shipment? If not custom will charge according to the standard rates they have. I think basically DHL person who is doing the K1 form and not the custom. Unless custom dispute the shipping rates.

Once you paid getting back your money from the custom department  is going to be very hard.

They have the rights to charge you according to the rates like what Kherell77 said but most of the time if they included the shipping rates charges in the invoice you are basically safe on that side. Which what happen on your previous shipment. Company who shipped frequently have a better shipping rates.

Are you sure K1 form is by DHL? I believe my shipper put the shipping rate as zero since it's free shipping. Obviously DHL/custom didn't know that so they used their own rate.

Yes K1 is done by forwarder for custom approval. Custom wont do the K1 form for you. Their job is to approve or make changes if they dont agree with what your forwarder have declare.

When they put 0 means you will be charge according to their standard rates since K1 calculation is based on CIF.  Shipper still need to pay the shipping charges no matter what.

So I won't have a case even with DHL as long as my merchant doesn't state it's shipping amount.
