Hi fellow sifus here, got a question regarding custom duty. My item imported from US after conversion to RM791.30 (with invoice) and I was slapped with a 30% importy duty. But there's a statement there stating items of value below RM800 are exempted.

Can I dispute it? How should I do it?
Please help...

Hi guys, I've ordered toys from japan website, DHL was the courier, to my astonishment I've being charged for a total of RM259 for the import duty! the officer declared my item as plastic and used the HS code 3926 90 9900. the worst part is it that have paid on my behalf without my consent! what can i do?

How much is the total cost of the toy including shipping?

I think they used the wrong tariff code.. Try to look for the tariff code for toys here http://tariff.customs.gov.my/

the code they used is for some weird item under 3926

The item i bought is RM407, the shipping cost that the shipper charged me is 1930 yen, which is around RM70, but the freight charge in the screenshot is actually charges done by customs to DHL(clarified by customs). The customs even clarified that the HS Code in place is actually wrong for toys.

May I know, what is the best next course of actions for my case?

Best to speak with customs or DHL.. print out a copy of the tariff code that should have been used. Whatever tariff code was declared customs will follow. Question is who chose the tariff code for you? If it was DHL then DHL should be answerable. Do you have it in writing from customs that the tariff code was wrong?

What dispute you want to raise? It's already exempted. You only have to pay the GST RM47.48

Action figures should have Tariff Code 9503.00.2100 which carry only 6% GST. You can ask DHL to re-declare as they proceed the declaration without your perusal.

If no invoice/receipt, Customs will calculate base on value stated in Air Way Bill as it is compulsory in shipping regulation (declared value in AWB). With no detail list of purchased, likely Customs will take highest percentage of duties applicable. That's why in shipping, need to do proper documentation to avoid extra/unnecessary duties/taxes.

the problem with them is that, they keep kicking the balls back to kastam and so forth. can i take any action against DHL for paying the import duty without my consent?

I've shipped car parts from Japan rims, absorbers etc and most of the time they will follow 30%. I have also bought most of them from personal sellers and no commercial invoice was provided just the one stated in the shipping label.

Just make sure to state the amount properly not too low and not too high because regardless what amount you put you will definitely be charge tax since auto parts will always be taxable.. it will be too obvious for example to put a price of Yen 2,000 for 2pcs of 15" wheels in one box no one will believe that.

There have also been cases where in I was not charged any tax for bringing in 2pcs 15" used wheels from Japan, maybe because it was used and the guy who sold it to me did not bother cleaning the brake dust off it it was looking so filthy that when I opened the box in front of the custom officer he or she just said ok and gave me the paper so I can have it processed without tax

Yes that's what my friend told me too, exempted for import duty and only charged with GST.
Problem is I appointed Pos Malaysia to clear the item, and they are now charging me the import duty+GST+clearance handling fee.

Dealing with Pos Malaysia staff is really hell.
In this case, can I bypass Pos Malaysia and clear the item myself at KLIA using this form from Kastam?

Tell them that you will ONLY pay base on Customs Official Receipt + handling fees. They can't charge you if they didn't paid the import duties to Customs. K1 Form is not official as it's only draft for submission to Customs by Pos Malaysia. Amount in the Official Receipt should be match with total amount after exempted in K1 Form ( RM47.48). Below Official Receipt sample from mine...

Thanks for the advice.
All this while I'm thinking this K1 form is prepared by Kastam declaring my item is exempted. Didn't know it is prepared by Pos Malaysia.
I used this K1 form and argued with the Pos Malaysia officer and manager for quite a while, finally they reissue another form instructing me to pay GST and handling fee only. biggrin.gif

Wanna ask, planning to buy a Computer from US (Maingear). Price of the item will be RM22xxx (Cost of item + Shipping) Its weight will be more than 40 KGS (Computer + Shipping packaging/foam).. I just have to pay 6% GST for the custom clearance right? Or do i get any other tax?

Hi sifus, just bought a watch online shipping from Singapore with DHL.

I thought it was tax free for watches, but I checked tariff.customs.gov.my and it says 20%? Which tariff type should I choose from the drop down, PDK 2017 right? So if this is true, they might impose 20% + 6% GST?

Wrist-watches, pocket-watches and other watches, including stop-watches is fall under Tariff Code 9101.xx.xxxx which carry only 6% GST.
