 Renting a house/room, Agreement? stamping?

Guys... if i were to rent out the room, the agreement i can do myself? is there any format or terms condition on how to do it?

And... how to make the agreement as genuine OR presentable if one day it's needed to sort out some tennat's problems?

i think if you actually want it to be enforceable in court, you will need to stamp it. there is a formula to calculate the stamp duty, based on the yearly rental, and period of tenancy.

rental is taxable. a good source of income for the government.

it is always adviceable to have a contract to set the limits and boundaries of your tenant's rights.

however, most people don't bother when it comes to room rental.

yea... my fren says those who rent the whole house usually will declare lor.. those for own stay + rent out room wont declare...

the stories that i heard is you need the agreement to be signed, but only stamp it when you foresee there is problem, i.e. when you need to report police or worse court case. the only benefit i know out of this is you save some money on the tax ...

the problem is, you have to date the agreement around the time it is signed. and you have to stamp the agreement within one month from the date of the agreement, if not there is a penalty.

how much is the rental and how long is the term? i can estimate the stamp duty for you.

RM380 for 1 year

of rm380 per month, it should be around rm10 for each copy. however, do double check with the stamping office 1st, as i am not too sure.

so basically i will jst have to pay rm10 for the agreement, 1 for me and 1 for the tennat. so both RM20 lor?

unit duti setem, lembaga hasil dalam negeri.
there is 1 at menara pgrm cheras, 1 at kampung attap, 1 at jalan duta.

but like i said, i am not too sure about the amount. i think it is rm10. but get the document signed, go to the stamp duty office, and ask. if it is too high, just leave without stamping it.
