Man jailed for sodomising two boys fails in appeal bid

KUALA LUMPUR: He tricked two boys, who sell nasi lemak from house-to-house during weekends, and sodomised them on different days.

On the first occasion, a 12-year-old student and his younger brother went inside the unemployed man’s house without realising that the accused has no interest in buying the food.

The accused - Toh Kai Seng, 45, sodomised the older boy in the presence of the brother.

The next day, the two siblings went back to sell the nasi lemak at the same neighbourhood in Pantai Dalam where the younger brother, a 10-year-old pupil was lured to his house again using the same ploy and was sodomised.

The two boys later complained to their elder brother who lodged a police report over the matter.

Toh was arrested and charged. He claimed trial at a Sessions court here to sodomising the boys in his living room between July 30, 1999 and the next day.

On March 2, 2004, the court sentenced Toh to 30 years jail and ordered that he be given four strokes of the rotan for both charges after calling him to enter defence. He chose to remain silent.

Toh has three previous convictions for sodomising children in 1995
