how do i determine if an act is ultra vires?

I mean for example, if a director of a company is required to hold shares in a company within three months of an appointment and on the 2nd month, she enters an agreement regarding renovating company's premises (2nd month = no shares), is the contract still legally binding?

Y dun u post the Q here..i think they can help also smile.gif

I have one question are we litigating in the courts in BM ? If by god i have to do that save me ....
*
i read in the newspaper recently, i think on sun where there was an article abt the malay language in courts ler..if i'm not mistaken, 30% of them still converse in malay and they r still doing so despite the hardship in translating those legal terms in malay since some of them r hard or they just use back the same words but different spelling kua lol smile.gif

not so sure for litigation since i'm currently in the conveyancing line xD

i saw the bac timetable for a level and the lecture time is very short. can they finish earlier?i know any details?
*
Hmm, what u mean but the timetable and lecture time very short? o_O dun really understand ur Q.
From what understand regarding ur Q is that the duration for classes is too short but u r asking whether can finish earlier? a bit the contradicting rite? xD or izzit that u meant by the duration of the course is too short of 1 1/2yrs? or can it be shorter ie. 1yr? sleep.gif

U gotta clarify ur question before any of us can answer it. rclxub.gif

that is why i ask the fellow forumer to consult their lecturers and if still confusing consult the person who is control of their program which is in the 2f of BAC .Having trouble getting there ? just take the elevator up from the Ground floor up to the 2nd floor and once it is open you will see two pathway's on your left hand you will enter the premise which leads you to the admin office and the receptionist and on the other hand which is right you can use the stairs to maneuver self around the college .YOU Cant miss the receptionist .... except if she is on a coffee break or you have arrive at 8.00 am.
*
lol..i dun c where r u getting at? y r u telling me the directions or whatever to inquire info from? i'm not the one who is seeking for answers..btw, a forum is not only for asking questions but also to join in the chatrooms or discussions as such. So ur "explanation" doesn't do any good either.

Added on July 9, 2009, 3:04 pmfurthermore, what is the difference between cie a level law and edexcel law?
*
lol..in the beginning u'll get that feeling, once u r settled in and there would be more revisions and extra classes i guess. This is not like SAM where everyday u have classes just like back in high school doh.gif

Hmm, i have no idea...someone else would explain it better to u. Although this Q has been asked few times already in the forum but not particularly in this thread.

Depends.

Most KL firms with big names, and big pay ( at least bigger) work harder, learn more (I assume). I've known some of my friends who work until 2 am everyday. very stressful. If you prefer that kinda life, then look for a firm that from the interview says "we expect you to stay back late"

If not, then choose a reasonable firm where they will expect reasonable hours from you. Most firms I know in Pj/SUbang are more laid back and go back about 6-7 sometimes later depending on the workload.

Corporate and Litigators i feel are the 'late stayers and early comers' of all.

If you're doing the external law degree under UOL. with most colleges/universities around (most famous would be either brickfields or Kemayan or KDU or HELP) I think they are the ones doing the degree now. You should have no problems with doing the CLP and being called to the Bar. So long as you have a 2nd lower honours and above. If you get a third, you will not be able to sit for your CLP and will not be called to the BAR, so please be VERY careful about this. I'm not sure if they changed this already.

Alternatively, look at the Legal Profession Act 1976. You can find this act in the Bar council website OR the AG's Chamber's Website (where they have all the acts of Malaysia there). In the Act, they will dictate what universities are exempted, what are recognised, and so forth, it should be able to cover all your queries regarding whether or not you qualify to be called to the bar.

however if you find yourself not understanding the Act, then you might just want to call the Bar Council Malaysia's HQ and ask them about admission to the bar. They are helpful if you can get them. (they're really busy)
*
I've heard corporate and litigation is always the ones who r stressed out and come home late (very late i mean) tongue.gif
conveyancing is the laid back section ler smile.gif
btw, it's still the same as for now regarding on the minimum grades ie. 2-2 to qualify for CLP

hi all, i'll be enrolling for the LLB London External programme next year, but i'd like to start studying now prior to my intake.

Where can i get the textbooks (recommended by U of London to be used for this course) for the 1st year (intermediate exam)? the subjects are as follow:

Common law reasoning and institutions [2650030]
Criminal law [2650010]
Elements of the law of contract [2650040]
Public law [2650020]

i hope some seniors here can guide me. I dont know if i should get the original textbooks, or photocopy ones (i know, illegal it is hahaha)
*
U can buy new books if u want to if u have the money but there's nth wrg opting for the other option. It's whether u eventually use it or not xD coz i've bought new books myself which i did not use also doh.gif

As for advise, just take and learn things at ur own pace and make sure u really understand 1st and when it comes to exams, study smart ie. go through the past year Qs so u can roughly know what kinda Qs u will be expecting then practise on that. The exam structure in my year and now is different for CLR and Public law i think so can't really comment much on it. The rest is really simple and straight forward itself by looking at the subject ie. criminal and contact law smile.gif

All the best ya! smile.gif

Hmm, obviously it's advisable to come from a reputable university but then again, for those who choose to do it in a local uni, i dun c the problem since there r also a lot of lawyers who r from local uni who did not have to take CLP since they r already exposed to M'sian law.

Ok.. and yes i was talking about A-lvls ... sorry for the confusion

So anyway what if i'm thinking about a double degree in business and law ?

Would taking 3 to 4 subjects from Law, Business Studies, Sociology, Economics or English remain the best option ?

Oh ok. Hmm, for me..since i intend to take up Law so i'll just stick to Art subjects. But maybe for u is a different thing. Maybe u have interest in science subjects which doesn't prevent u from taking it up. Just bear in mind to achieve the required grades only lor smile.gif

UK university graduates have to take CLP in order to practise law in malaysia, before they pass the test, can they work in a law firm or legal department?
*
lol..u can work during ur 3 months holiday while waiting for results esp. for UOL students since UK transfer students will get their results abt 2-3weeks after the exams. Before graduating with a degree, u will work as attachment students lor..after graduating, u'll be paralegals/legal executives. Whilst chambering=chambering student/legal assistant smile.gif

QUOTE(chelsh @ Aug 20 2009, 04:25 PM)

Hmm, if u want to be exempted from CLP then go for local uni's ie.UiTM, UM etc,..
other courses ie. Bachelor of Jurisprudence could be a choice smile.gif but if i'm not mistaken, u can't practise with BOJ kua o_O

QUOTE(cutetweety @ Aug 23 2009, 01:21 PM)
Hi,

I've registered for the UOL (External) LLB degree after 2001 and am currently waiting for my final result. Just wondering, IF I should fail to obtain the required Lower 2nd Class degree as required to qualify for the CLP, what alternative routes can I go for in order to qualify to practice law in Malaysia?

ps: this is already my 4th year after passing my intermediate exam.

Thanks smile.gif
*
ur final results meaning part 2 also i would assume? hmm, can try taking up the arbitrator course? tongue.gif or become legal advisor in companies lor
there r no other ways unless u repeat ur degree or opt for BAR after that..unless u appeal and they accept ur appeal

If you are taking the UoL External LLB programme, you will need to secure a minimum second lower honours in order to qualify for the CLP examinations.

If you are currently enrolled in one of the numerous twinning/transfer LLB programmes (2+1 / 1+2) available though, I don't think this ruling applies.

Anyone here who can confirm this? Thanks smile.gif
*
For UK transfer, a pass is only required for CLP. I'm sure abt UWE but not really sure abt others..but it may be around that mark i guess. xD

Yes they do.

They refer to Practitioner's text from England, India, Australia, etc.
These are persuasive authorities.

However, if you can find a Malaysian case that recognises the case or principle that you are relying on, then that would be binding.
:-)

*subject to the case being distinguished...
*
You can apply the principles and common law from England if there r no special provisions or M'sian cases to support ur case. It shall be applied so far as the same shall not conflict or be inconsistent with the Code or other provisions in M'sian statutes.
