Sure but its still beneficial to consumer at the end of the day, see some one with a low end Nvidia graphic could achieve more FPS which would normally be laggy without opimization. Some calls it cheating but to me it still benefits consumers.

Raw GPU power, FPS all means nothing if you can't play the game how you want it to be played.
Which is why I like HardOCP's reviewing method, that looks at what settings the cards can play, and compare image quality as well. A far better way to benchmark and decide what card would suit you best. On the sidenote, Nvidia drivers > ATI drivers

Cuz they have money to sustain the whole driver development team
ATI drivers arent as bad as they used to be but still not as good as Nvidia and that i must admit
The stability of Nvidia's driver is first class.
On the other hand with ATI you'll need to be some sort of geek to used it
