HI ALL like title

i sell my ASUS HD 3850 256MB TO A PENANG BUYER . i comfirm the card is on great condtion b4 send out via postage. now the buyer blame me for selling a spoil fans with 1 blade is broken. maybe is broke during in the shipping.

now the buyer want me to refund . how i gonna refund as the blade is not break by me . so we agree (both side buyer n me as seller ) set up this poll to decide who have to respondsible for the broken fans.

if the seller vote have majority - i as seller will refund the buyer .
if other way buyer have to accept will not ask for refund again .

PLS ATTENTION IF U DONT KNOW PLS VOTE THE THIRD OPTION . THIS IS THE IMPORTANT VOTE.

PLS DONT VOTE WITHOUT READING THE WHOLE STORY . THX ALL

should have purchased insurance from poslaju or the courier and claim from them,
in this case usually the buyer/courier has to bear the cost,
insurance charges are around RM8 for damage claims up to $400
so next time insure your package and charge the buyer for insurance.

if he refuse the insurance, then only you can ask him not to blame you for damages.

1st time hear such thing, but insurance should be beared by both party equally.
Why must buyer bear all?

Fyi, in law terms, seller are required to be responsible with handling damages (if any).

It think its seller fault. We know pos laju dont handle their package professionally you should either

1) Wrap the package in a box and seal it tightly and properly
2) Choose a better courier but if buyer choose poslaju then buyer should bare the risk

but we really dunno the truth from the moment u unplug and package it anything can happen as well.

but since no prior agreement on insurance been discussed between buyer and seller???,
therefore the law says that the seller and courier company has to take responsibilities.

i as a seller, i meet with this situation before. it was mishandling of the poslaju. somehow, the item was around rm10, so i just told the buyer to pay for the shipping fee and i'll sent another ones to them. but your item was quite pricey. so if it was the fan that broken, TS why dont you just replace the fan for the buyer?(if its quite cheap lar, if expensive, you can request the buyer to pay for partial of it).

thats my opinion.... correct me if i'm wrong...

eh.. is ur GC fan already broke? cos i've sent item before using courier but nothin happen bad in my package.. cool2.gif

1 blade of fan got broke sound like unbelievable.. blink.gif

i said this becos the box itself r strong enough to protect the package.. flex.gif

is the box r crumpled? or got tear? or damage? rolleyes.gif

if tat happen, maybe the courier can be blamed.. shocking.gif

if the box r well enough n nothin bad happen to the boxes, than the seller can be blamed.. shakehead.gif

ops.. this my opinion la.. either true or not r depends on seller n buyer.. thumbup.gif

I can say seller fault...should pack nicely...as we oledi know the pc part is quiet fragile...happen to me twice...luckily the first one i just glue it than it's ok....but the mistake is both of the item no FRAGILE tag and unappropriate in term of pack the item....if me I will pack the item untill i'm satisfied than the rest i will hand over to courier company and remind them the item was fragile....
