The "Special 301 Report", filed with the U.S. Trade Representative, highlights the ongoing battle against software piracy in a number of countries. It urges a number of nations where piracy is rife to clean up their act by bringing their copyright and enforcement regimes up to international standards and opening their markets to legitimate products as a matter of urgency.

According to the report, piracy is a persistent problem in Canada, China, Malaysia, Russia and other parts of Europe, with piracy levels exceeding 90 percent in some markets and threatening the videogame industry's growth.

Specifically, the report states that "legal and enforcement deficiencies in Canada" have allowed pirated copies of games and circumvention devices to permeate the retail market and that "pirated optical discs and cartridge games manufactured in China and Malaysia stunt legitimate game sales in many foreign markets".
