This is gaming softwares (ESA host the annual E3 show) specific and nine countries were mentioned, sadly but not unexpectedly, we're one of them.

Source: ESA: Combat Piracy or Face Damaging Sanctions

QUOTE
The "Special 301 Report", filed with the U.S. Trade Representative, highlights the ongoing battle against software piracy in a number of countries. It urges a number of nations where piracy is rife to clean up their act by bringing their copyright and enforcement regimes up to international standards and opening their markets to legitimate products as a matter of urgency.
QUOTE
According to the report, piracy is a persistent problem in Canada, China, Malaysia, Russia and other parts of Europe, with piracy levels exceeding 90 percent in some markets and threatening the videogame industry's growth.
QUOTE
Specifically, the report states that "legal and enforcement deficiencies in Canada" have allowed pirated copies of games and circumvention devices to permeate the retail market and that "pirated optical discs and cartridge games manufactured in China and Malaysia stunt legitimate game sales in many foreign markets".
QUOTE
"Freeing these markets from the pirates' stranglehold will also help empower a local video game economy."

the article is really poorly worded.

lets see

QUOTE
piracy is a persistent problem in Canada, China, Malaysia, Russia and other parts of Europe, with piracy levels exceeding 90 percent in some markets and threatening the videogame industry's growth  .......

In 2007, our industry had a record-breaking year with receipts totaling $18.85 billion, but piracy closes off promising markets, artificially limiting our industry's ability to contribute even more economic growth to the American high-tech economy and economies of our trading partners.....

!? they have a super profitable year and then claims made-in-malaysia uncle ho games are limiting them from making even more profits !? the magnitude of internet downloading piracy problem in some of their "ori" countries dwarf any local uncle ho operations, just look at the lack of psp games sales in US, EU or JPN tongue.gif

mega game publishers and developers have no problems off-shoring game development to "cheaper" developing countries like India, Vietnam, etc to cut cost and increase profits and then complain the very ppl living in those "cheap" countries are not buying their USD50, 60 games!?

ESA is really just a wayang show. even if they put alot of pressure and Malaysia local shops somehow miraculously get "cleansed" similar to what happened in HK and SGP years back, uncle ho will most probably shift his ops to Vietnam or Laos, etc and start again laugh.gif

if they really really care about nurturing and opening "promising markets" in developing countries, they can always bank heavily in the pc MMO games model. start playing for free/low price, then charge subscriptions or sell DLC.

they forgot to interview hundreds of ISO-rippers groups in America which always earnestly release their new findings into numerous torrent trackers which always based in USA. A classic example on how americans put the blame on others.

yup..

it may b true, piracy is rampant in Malaysia..
but

we are only a very tiny country..

most of the torrent (be it movie, games) originated & downloaded mostly from US & Europe..
where hi-speed broadband consider cheap,.

So, Malaysia shouldn't be in the list because:

1. Mega publishers/developers are already rich
2. We earn less
3. We are a small country
4. ISO-rippers are actually american
and...
5. Malaysia Boleh?

they say malaysia in on the list because those uncle ho dvds are being exported to other countries (i think SEA and M.East countries). this is the same uncle ho empire they chase out of HK a decade ago. with alot of enforcement (money+time), they can hassle uncle ho to move their base from Malaysia, but i'm sure they'll just setup somewhere else.

ofcos, seeing uncle ho games sold openly everywhere is not an ideal situation for Malaysia. i think what they want to achieve is something similar to HK, SGP, TWN or S.Kor where ori games are sold openly in gameshops while pirated games are sold in shady places.

from the article
QUOTE
....Excessive bureaucratic delays in title approval
....owing to high tariffs and additional taxes
these are also reasons why they can't break into "promising markets".

That's because we have come to look at media entertainment as a need and not a luxury, whereas the exact opposite is true. Things like video games and movies are indeed a luxury, but piracy seems to has spoiled that concept for us by allowing us to buy at ridiculously cheap prices, thus the actual real value of the item is diminished in our society.

I beg to differ on this one. Even WITH PIRACY, media entertainment is still considered BY MANY as a form of luxury coz not many people can buy it (referring to the console). Even during the NES era with the cloned NES and pirated NES Cartridge, video games are considered a luxury. If not, until now, why does pay-for-play service still exist in Malaysia? Some even pay RM6-8 per hour for a PS2 session (somewhere laa no need to disclose location biggrin.gif )

By the way, as for dvd movie, I like the way SPEEDY VIDEO is selling some greatest hits 2 Disc special edition of movies (priced between 39.90 and 59.90) at many of their chains now. I'm buying more ori disc than I buy pirated dvds nowadays. rclxm9.gif

Phoenix and Darquarma do have a point. To some, consoles are reasonably priced, and to others games are reasonably priced. They would normally pick either one, and not look as both as the winning factor.

From what I can say, piracy fulfills the wants and of us to play everything that we can. Whereas original titles is to promote playing. In truth, not everyone has to play everything, but piracy fills that gap for some people, which in the end leads to not supporting the game industry in terms of buying original.

Ah well, I prefer to stick to originals. If everyone buys pirated, we won't be seeing sequels anymore ey?
