After i hav make the payment, the lawyer i hired to proceeded for all the documentation, S&P la...blah...blah.... delayed the process. Owing to that, i hav one one month of defect liability left for my new house. After sending 2 times of defect complaint, at last i found that the valve in my reservoir tank is not functioning. I wanna to extend my defect liability can or not? If cannot, can i make a complaint to the lawyer whom delayed it? What should i do now? how do i going to write the request for extending my defect liability? please someone help me because i am newbie in buying house.

@yon325,
Have U oredi reported it to the developer? Also, the defect list usually starts from when the house has been handed to you, not from the date the house is built !

the liability given by the developer only till end of 2007. According to my S&P lawyer, she said it could be negotiate....by sending a letter with the chronological order of the event. Anyone faced a similar situation before? pls help me.....

Your house finished construction more than a year n haf ago? Usually the defect liability period starts from the delivery of Vacant Possession (VP). 18-24months....and if your lawyer says can, then shd be alrite. Best to demand from them since they were the ones who delayed the process and all.

You can't extend the DLP, and the developer will usually cuci tangan after it expires.

They have no obligation to fix any defects unless its mentioned in the initial complaints form and its unresolved or overlooked.

Please check the exact date of the handover of the house from developer to you. Usually there is a letter one.

Your defect period should start from that date and not earlier ie when the house completed building as some other bro mentioned above.
