Post mortem shows Durian Tunggal victims were executed, say lawyers

PETALING JAYA: The families of the three men killed in a police operation in Durian Tunggal, Melaka, last November have alleged that post-mortem reports contradicted the police's claim that the officers acted in self-defence.

With fresh evidence in the post mortem reports from Melaka Hospital, the families are demanding an explanation why the policemen involved in the shooting have yet to be arrested and charged.


Lawyer Rajesh Nagarajan who is representing the families said the post-mortem reports have made it clear that this was an execution-style killing.

"They were made to kneel before they were shot. There was no alleged attacks on the policemen," Rajesh said in a Press conference today.

He said the reports revealed downward bullet trajectories and evidence of close-range gunfire, which he said were inconsistent with the official account that the victims were shot after allegedly attacking the police personnel.

"There are no more excuses for the police not to arrest and charge them. We just want justice."

The three victims — T. Pooneswaran, 24, M. Puspanathan, 21 and M. Logeswaran, 29 — were killed during a police operation in Durian Tunggal on Nov 24, 2025.

Police have maintained that the men were shot after allegedly attempting to attack officers with parang along the North-South Expressway, forcing police to open fire in self-defence.

It was later discovered that Logeswaran's wife had been on a phone call with him even before he was stopped by police and inadvertently recorded the incident, until the final gunshots.

Rajesh said the audio recording showed that none of the three men had provoked the officers, with one of them allegedly heard pleading not to be killed before the final shot was heard.

Melaka police had then claimed the three were Durian Tunggal gang robbers who were on the way to commit a burglary in the area when they were intercepted by police.

Rajesh said the post-mortem findings reinforced the families' claims, which were also supported by the audio recording obtained during the incident.

Reading from one of the post-mortem reports, he highlighted the finding that the bullet's path was "from front to back, downwards and to the left", adding that the report also recorded "powder stippling" and "soot soiling" around the gunshot wound.

He said the downward trajectory suggested the victim was in a significantly lower position when shot, while the presence of soot indicated the firearm had been discharged from extremely close range.

"The police are saying that this is self-defence. The post-mortem reports show otherwise.

"It is very clear from all three post-mortem reports that the angle of the shooting and the trajectory are from top to bottom, indicating a shot fired at someone kneeling down," he said, adding the same forensic characteristics were present in all three reports.

Rajesh said that his interpretation was based on findings documented in the Melaka Hospital post-mortem reports.

He also claimed the police and the Attorney-General's Chambers (AGC) had been in possession of the reports for several months before the families obtained copies only a few days ago, questioning why no arrests had been made despite the findings.

"We only got a copy of the post-mortem report two or three days ago. Despite this clear evidence, the police have not arrested anyone, have not remanded anyone and have not charged anyone.

"All that they have been saying is, 'Kita sedang siasat' (We are investigating)."

Rajesh also pointed to what he described as another crucial forensic finding contained in all three post-mortem reports — the presence of "powder stippling" around the entry wounds and "soot soiling" within the wounds.

Quoting directly from the report, he said: "Powder stippling was noted around the wound. Soot soiling was seen on the inner aspect of the wound."

He said soot deposits are typically associated with close-range gunfire.

The lawyer pointed out that more than seven months had elapsed since the killings.

"No one was arrested, no one was remanded, which is completely illogical.

"It does not make sense at all for the police to investigate the police, which is what is happening right now," he said.

Activist Arun Dorasamy, who was also present at the press conference, said the families had fully cooperated with investigators by providing intelligence, enhanced audio recordings, frame-by-frame analysis and information they claimed could identify officers allegedly involved in the incident.

"We personally, together with the families, spent more than 30 to 40 hours with the police and shared all the intelligence that we had," he said.

Arun said the latest forensic findings reinforced evidence the families had previously submitted to investigators.

Arun said Cabinet Minister Gobind Singh Deo had sought answers from the AGC, while Members of Parliament Datuk Seri M. Saravanan, Law Reforms deputy minister M. Kulasegaran and RSN Rayer had repeatedly raised the matter in Parliament.

"Unfortunately, responses from the Home Ministry had consistently been that investigations were still ongoing, but for how long?" he asked.

Conveying the families' demands, lawyer Sachpreetraj Singh Sohanpal said the victims' families want the Inspector-General of Police Tan Sri Mohd Khalid Ismail and the Attorney-General Tan Sri Mohd Dusuki Mokhtar to explain the delay in the investigation and prosecution.

The New Straits Times has contacted Mohd Khalid, Mohd Dusuki and Criminal Investigation Department director Datuk M. Kumar and are awaiting their response.

Mangsa 1 berulang kali menyebut: “Mudiyaathu / Tak boleh / Tak jalan.”

Perbualan Tamil menunjukkan kereta terlebih panas, air-cond rosak, dan cubaan untuk menghidupkan enjin gagal.

Isteri Mangsa 1 menyebut ramai orang di Shell, menunjukkan kemungkinan kejadian berlaku selepas dikejar.

Mangsa menyebut:

“Ma, mereka dah tangkap kami!”

“Kereta sudah habis.”

Tiada sebarang agresi oleh mangsa. Mereka ketakutan dan dalam kecemasan mekanikal, bukan melarikan diri.

Kontak Pertama Polis – Nada Mengancam** Suara dipercayai polis mula mengeluarkan arahan keras:

“Keluar!”

“Baring!”

“Diam la!”

“Duduk! Sit down!” (Nada marah dan mengawal)

Rakaman dipenuhi suara kesakitan, jeritan dan rintihan mangsa, menunjukkan berlaku tekanan fizikal yang kuat.

Hanya ketakutan, kecemasan dan kereta rosak.

4. Kesimpulan

Berdasarkan rakaman audio, terdapat bukti kukuh dan konsisten mengenai:

Pembunuhan secara sengaja / gaya eksekusi,

Tiada ancaman daripada mangsa,

Penggunaan kekerasan berlebihan,

Kemungkinan manipulasi tempat kejadian,

Usaha memusnahkan bukti.

Rakaman ini bertentangan secara total dengan naratif polis berhubung:

Kononnya berlaku tembak-menembak,

Mangsa menyerang polis,

Mangsa bersenjata parang,

Mangsa melarikan diri.

Rakaman ini adalah bukti utama untuk:

Siasatan bebas oleh Bukit Aman D5,

Siasatan EAIC / IPCMC,

Aduan rasmi kepada SUHAKAM,

Tindakan disiplin serta pendakwaan terhadap anggota terlibat.
