No lawyer can help you ... serious answer which will cost U 1k from a lawyer for legal advise and SST 🤑

For example, if co-owner doesn't want to sell, no law can compel him to sell. Tis is the right of every owner, except for land acquisition by the govt for public use and the in kambing URA.

That is the reason why some properties remained abandoned by joint owners purchased because they can't come to a solution. Inherited properties with joint names also face such problems.

But sometimes, money can makes him change his mind.

So what about is the unresolved disputes ?

Sometimes, banks can 'help' if your have loan. But tis approach will have repercussion. Do it only U want 'a knife to cut two' 😭

Dispute between co-owners is only about money.

If one don't want to sell, what is there to sue ?

Unless TS can proved to the court for eg that the co-owner benefited more from the joint ownership, then the judge may order a forced sale and distribute the proceeds.

After deducting outstanding loan, legal and sales expenses, there may not be anything left to distribute ... but a 'legal' way to severed friendship 😅

In co-ownership, it is deemed equal shares unless specifically stated in the the land title.

Benefiting is when one co-owner receives rental income without benefitting the other co-owner.

Payment and upkeep is expensive benefitting to sue in court. The plaintiff can choose to stop what he is doing and let the law takes its course. Why keep paying when there is no certainty of getting back what are paid esp if the property is later sold at a loss ?

More likely the property will be sold at a loss and the sales proceed cannot cover the loan.

Owners have to pump in money to effect the sale, otherwise the bank won't signed off. If the other co-owner has no financial means, how to sell ? Even if he sign the SnP, the deal will later be aborted and more cost incurred.

Unless ts undertake in writing to take care of the losses, possible the co-owner will sell. As stated earlier, is all about money.

Or maybe, the co-owner is hoping for the property price to go higher ?

1. Do U have paper evidence about the rental income ... a copy of TA?

2. How much was your annual share of the rental income ? How much is the total todate ?

3. What is the estimate sales proceed U are expected to receive ?

4. U can also play the reversed game if U are not in need of the money.

Even when TA doesn't have co-owner's name, he is deemed to to have received rental and to declared his share to lhdn in his annual tax returns.
