Unless TS can proved to the court that the co-owner benefited more from the joint ownership, then the judge may order a forced sale and distribute the proceeds.

After deducting outstanding loan, legal and sales expenses, there may not be anything left to distribute ... but a 'legal' way to severed friendship 😅

depends who has higher percentage? or one has relinquished payment and upkeep while leaving the other person to handle everything?

yeah, in any court case, lawyer is winner, both parties are losers...

Payment and upkeep is expensive benefitting to sue in court. The plaintiff can choose to stop what he is doing and let the law takes its course. Why keep paying when there is no certainty of getting back what are paid esp if the property is later sold at a loss ?

let law takes its courses... maybe one party doesn't want his credit score gets tarnished... just speculating.. ts sure has more info to his predicament.

Owners have to pump in money to effect the sale, otherwise the bank won't signed off. If the other co-owner has no financial means, how to sell ? Even if he sign the SnP, the deal will later be aborted and more cost incurred.

Unless ts undertake in writing to take care of the losses, possible the co-owner will sell. As stated earlier, is all about money.

Or maybe, the co-owner is hoping for the property price to go higher ?

So ts found solution already or not..

Told ts have a lawyer to recommend. Also didnt dm..maybe he found one.
