Hi Sifus, need some advice/opinion on this matter.
I'm a noob when it comes to this.

I selling my apartment via an agent and got a buyer. And I am required to get a lawyer for the selling process (SPA, dealing with bank for my loan, etc).
The agent intro his panel law firm (Firm A).
And I've also contacted a law firm that handled the strata title change for my unit. (Firm B)

Selling Price - 235K

Now here is the situation. The Perfection of Transfer is already done. But the Perfection of Charge is not. Firm B didn't contact me all these while and I too didn't inquire further.

In an event I am not selling my unit, I need to settle the Firm B fees to complete the PoC. And the bank hold the grant.
Not sure why they are holding on to it.

But now I am selling it. My question is that, if I appoint Firm A, can they request the grant/title from Firm B without completing the PoC.
Will Firm B then say to complete the PoC and deal with the bank?
The reason is that I don't want to pay anything additional apart from the quote given.

Why got 2 different firm for POT and POC. Lagi senang ma.

Better ensure POT and POC discharge by same lawyer. Any fuck up you headache. POC got stamping also assignment of deed yada yada. So dont play fool save few ringgit . Legal part do properly.

POT and POC are normally done together. Are you sure the POC is not done ?

Not sure why your bank is holding the title without the POC which is not in their best interest to protect their loan to the borrower.

I believe your POT not done yet eventhough the stamping of the MOT may be done. The title and MOT should be sent to your POC lawyer. If the POT lawyer did the transfer, then he is in breach of duty. But lets say the title already transferred to you and kept by POC lawyer. No need to do POC, can sign SPA and let buyer settle your loan and then do DRR.

Ah Okay. Thank you all for the reply.

I think my info is a bit not clear.

Firm B was appointed by the developer to perform the title change from developer to individual (do both PoT and PoC).
I was informed Firm B, that they have done the PoT but not the PoC because I didn't pay the PoC fees yet or contacted them to finalize this process. Therefore the grant is still with them and doesn't have the bank info in it.
Note: the stamp duty has been settled.

I told them I am looking for a lawyer to perform the sale, they suggested to engage with them - supposedly it would be easier.

My question, if I engage another law firm (ie:Firm A) to do the sales process, do I need to complete the PoC first (by paying the legal fees of Firm B), only then they can proceed?
Or this DRR process allows to bypass it. I am just afraid the Firm B will say that I need to pay some legal fees to complete the PoC, etc. That means i need to pay both sides.

Ok since u are selling something of not too big value, my advise is use same lawyer as buyer.

So lets say buyer punya lawyer is call lawyer C

So, now wad is pending is, u settle the payment needed to get POC from lawyer B.
After lawyer B settle all siap siap habis nice nice, then proceed to ride along lawyer C of the buyer.

Then the lawyer C represent buyer, u are just riding along, and you fee should not go above rm1.5 as it will just be for some disbursement fee..

If u want to proceed with lawyer A or B, that means A or B will represent you if the transfer got issue, delay or wadsoever..

Since it is below 500k, i think ride on purchaser lawyer is ok la

Your lending bank would required the poc to be endorsed in the title, then do a discharged when the loan is settled.

The question of not doing the POC is out. And whoever lawyer is doing the POC, he must be under the bank panel.

Banks have internal audit / checks to ensure that their interest is protected, otherwise they won't sign off any documents to the borrower.
