Buying car from direct owner

I plan to buy this car from the owner
Car itself is still under loan, about 38500
Seller agreed to sell to car to me at 37000, he will top up the remaining 1500 to fully settle the loan
Car itself has been inspected and deemed in good condition
Car owner is about 200km from my place
Car owner has paid his share, sent me the remaining outstanding loan screenshot and receipt of payment
The agreed plan is: - prior to meeting me at my place he will go to do puspakom ownership transfer inspection at puspakom nearby his place
- assuming the inspection result is a pass, he will come down to my place to meet me. We will then go to the bank counter nearby my place where I will settle the remaining balance of 37000.
- he will surrender the car to me and go back to his place
- since ebatal will take a couple working days (according to cimb bank, the loan financier of the car), on the day ebatal is done, car owner will go to jpj nearby his place to do ownership transfer thumbprint, and I'll do the same
An agreement has been drafting stating the above, and is signed by both side, in forms of both soft and hard copy
Question: what if owner tiba2 don't want to do ownership transfer at jpj, or even report the car as stolen?
First time buyer, will appreciate any advises. Thanks!

feels too risky somehow even though never done before...200KM he can easily run away, if it's in selangor you can insist he do transfer ownership then you do bank transfer same day/time at least safer.

This. Seller outstanding loan is his problem. If he cannot source funds to settle it first, plenty of other used cars for sale. Lowest risk is bank transfer in front of JPJ counter with the JPJ officer stare cock at you both before you hand over the $100 transfer fee.

What if I look for a secondhand dealer which provides ownership transfer thumbprint without having to wait for ebatal?
Meet at the dealer, do ownership transfer thumbprint, then I settle until left rm100, since the agreement stated when signed, I am to be authorized to go to nearby cimb counter to pay the last rm100
Will that be safer?

i've no real experience in this but somehow the process you described feels risky. suggest you ask those that have expertise in this area, or contact someone like "kon wai luen" (google him) - i think he should be able to advice/give suggestions
his youtube videos has telegram contact (i think its to his telegram group).

Have you ask the bank about this? Car dealer also can but have to pay the fee. But still they have to deal with the bank because ownership still pending.

From personal experience would suggest to through reputable dealer. Much less hassle, fairly easy and straight forward and they have runners for every steps of the hire purchase process. Further they have the thumbprint equipment so there is no need to go to JPJ. All the transactions will go through them and they will issue receipts. So practically no risk. They will also assist dealing with the banks on outstanding loans. The only downside is there is a fee to be paid.

The best way is for the owner to settle the loan first and get the ebatal. Then both of you meet at JPJ to do the ownership transfer. You get a bankdraft or cashier check for the balance amount and handover to him after the ownership transfer.
This is the safest way but if the owner cannot settle the bank loan first, can still do it as you agreed with him but ask him to pay another 5K towards the loan. Then you settle the bank loan minus that amount. After ebatal meet at JPJ for ownership transfer and pay him back the money. The 5K is to motivate him to do the transfer. He cannot report the car as stolen as you have a written agreement with hm.

r u in urgent to own this vehicle? maybe beginning pay few hundred as deposit enough. let seller settle bank n jpj apply tukar hak milik siap2. then only we talk about cod wherever u decide

My own experience buying direct from owner but way back in 2013 when there wasn't any biometrics ownership transfer in JPJ. Owner was an Iranian who has already left this country, so the process was done with the niece on behald of the owner.
What happened was, the owner was aware in order to sell aka transfer ownership of car, he need to sign forms and he had prepared it beforehand. Everything was signed and left the car grant and forms with his niece to find buyer. Me the buyer and the niece just agreed on a price, The arrangement with seller was he will handover the car once the e-batal process has been initiated aka loan settled. Then go meet at the Puspakom on agreed date (after called and getting an appointment date). This step you can arrange with the seller in advance and he (seller) can do it by himself.
After got the Puspakom lulus cert, we straight go to the HP loan bank branch (also find out beforehand with the seller which bank provides the loan and where is the nearest HP loan branch coz not all branch can handle HP loans) to settle the loan. At the bank, I gave him the bank cheque (bought earlier) of agreed sale sum and he top up to clear the remaining loan. Bank officer acknowledge the loan settled and pending e-batal clearance. So seller gave me all keys+remotes and I drove the car home after dropping him off at his condo.
After receiving email from seller that his bank confirmed e-batal already done, I straight drive to JPJ to do the ownership change without any hassle at all, Not sure if biometrics will be smoother but I think it should be, just that seller has to be there for the fingerprinting process.
I don't see the need to get 2nd hand car dealers involved as JPJ (at least Padang Jawa branch) nowadays not as pack as everyone think it is. Queue moving along very fast and gone were the days where you take a number at 9.30am, go yumcha and lunch, then only go again after lunch just in time for your turn.
