i would ask all of u, an opinion about my case. I bought used K750i from mnchong. She claimed it as her fren set. Deal was seal last wednesday and the item was sent to me by poslaju as the item at Perak and I at JB. I received the phone this afternoon....when i check the phone, i found that the MIDLAND sticker is already torn, the joystick cannot moved upward and the worst....it cannot detect MSPD!! from the thread (CLICK HERE) she claimed that the phone is well functioning. No wonder i didnt received the 64MB MSPD....no prob with that but its totally dishonest act by selling people faulty item by claimed it functioning well.

So, i just want my money back as i dont want to send it for repair...i dont want to keep this phone anymore even though its very nice...in appearance!
...please help...gimme some good advise. already told her, but she said her friend didnt answer...i just need my money back, dont want to spoil seller reputation..sorry.

Bug her to come and solve it, since she is the middle man and confirmed that everything was fine, so she should hold the responsibility for it.

How about requesting her friend to bear for the repair bill? wink.gif In this way, you can get to use phone, isn't this your initial intention of buying the phone? To use it right? smile.gif

However, it is always fair to listen to both sides of story, we shall wait for her to appear here and listen to her side of story. It is still early to make judgment. No offence ya! smile.gif

i can say that most of the seller are using the 'im selling it behalf on my friend' excuse to avoid any after-sales service, such as this case, so that they wont need to bear any responsibility if anything bad happened wink.gif

Next time those thread with 'im selling on behalf of my friend' etc shd be reported.

Back to topic : Did she said there's any remaining warranty from Midland? If yes (more than a month), then the best is to return the phone & get bk your money (midland sticker is tampered, thus void the wrty)

already sms her about this thread....for the 1st time, she said sorry about what happen and seems to take action but after few hours, she just keep quite..doesnt reply my sms anymore. i know this action would be tough but i`m very disappointed with what happen.

reposible seller will take the product back and repair it to send back to you.. As seller didnt say bout the problems on the phone. u can ask the seller to pay for the repairing services..

i wonder that the picture she advertised in her thread oledi show that the midland sticker oledi tampered. didnt you notice that??

But..did she stated that the phone is faulty?? PLUS...if u can see, there`s a 64MB MSPD + adaptor...both i didnt receive. Charger also not working!

i think not charger not working, most probally is the fast port being faulty sweat.gif

The fast port is fine...already test w other charger and earphone. Just the CHARGER itself that malfunction.

Because the account details belongs to seller, mnchong herself. i pay via her maybank acc...plus, she didn`t reply my sms anymore since the last 3 days. all her acts somehow make me feel like she tried to cheat me at the 1st place. anyway, i just want my money back. thats all...

1. She removed all the details of the phone in her thread here yesterday.
2. She has another thread selling k750 here , the similarities is it doesn't has headset too. the descriptions of the k750 seems very similar to the one in her thread where you bought from her here
3. Looking at all her threads here, all her WTS tags have the same "Reason for sale" which is "Friend need Cash.....$$$$$$$", BUT when questions are thrown to her regarding the phone she'll reply like this

What I'm trying to tell you in the 3rd point is, by judging on how she replied, you still thinking that she's selling on behalf of her friend or maybe the friend doesn't exist.

- ALL threads selling for friend, same reason need $$$$
- BUT when it comes to nego, she said she's looking for honest buyer
- and, when it comes to bank in, she gave her account number, and her details.

i just said it based on my experience. last june my W810i stolen, as well as my wallet...made a police report but nothing in return. Btw, i`m sorry....

it is a simple solution. it could difficult to get full refund, but if possible, ask for the service charge and it will be happy ending.

there is no use for police report, as there is no fact that it is a con case as you did receive a phone. unless you want to challenge with filing a court case.

I had been REALLY conned for RM4k without receiving any phone from XAVIERXXXX and reported police and yet no news after almost 1 year.
So do you think u can get any action?? it is just wasting your effort.

Ask for service charge and partial refund. I believed you can work out this way easier compare to asking full refund.

why i say this as the seller is not a regular seller and so the seller could be not bother about this forum at all. so u need to take some lost and at least you can get a cheaper phone.

i just come back from outstation and some of my friends on this forum had sms and called me to inform me about this unfortunate case.

I had contacted my friend who is the original owner of this phone.
When the phone was shown to me, it is really fully functional as i confirm there was no such issue as reported (joystick, memory and charger issue) but i do not manage to check further as when the phone was confirmed and was only passed to me in a box. It could be then faulty or whatever but it is unaware...

Well, there are two solutions here (as the original owner does not want to offer full refund)
1) discount of the phone of RM80 (as service charge)
2) return to me and i will get phone serviced and return upon return (but i do not know how long it will take, so there is some waiting time here) also i will not bear the phone shipment cost.

I just want to make the case simple as i can even challenge and argue that you could have damaged the phone and claim it is faulty upon receive. There is no proof of such that the phone is dead on arrival. I do not put up anything as warranty of the phone and it is fully functional when on my hand and so if it become faulty on your hand then it could be your fault. BUT I DO NOT WANT TO USE THIS ARGUMENT. Also pls understand the meaning of 2nd hand phone. it is not perfect in some way. if not it is not second hand.

It is not a million dollars and so pls pick either option 1 or option 2.

I had learned my lesson as well in this case. ..

Who cares anyway, this story is from your side only. Second hand doesnt mean its faulty, even if it is faulty u should state it. Why not u give kk_tai ur fren number and let them settle? or ask him to come over here to settle...

you think you can get the seller to pay you all the full repair cost... i do not think so.
grab the RM80 and better than nothing.
i would not even want to bother if it really need to get 100 or 200 to service...bottom line is you will not get all favourable to you.

u can keep writing your uneasiness, but end of the day, no one here can help except giving you emotional support. the emotional support would not get you anywhere, right?

just think. better than nothing. and deal no more with unknown seller next time.
it makes you better day rather than keep thinking for it.

act it is unfair to the seller,if he bring to a expensive shop and quote the price,it is unfair to the seller...maybe juz send to the seller and repair it....fair to both parties...

well, i will upload some pics of what i discovered when i sent it to the technician. i ask him to open the set in front of me so i can assure that the technician didnt take any parts from the HP. Guess what, some of the IC was burned!! and the joystick was installed back wrongly!! No wonder its cant push upward.. Picture upload.

I believed in this case, you have made a mistake. You had openned the phone without the agreement from the seller and the seller had not YET agree to you that the seller will pay you if you repair.

I do not think this case can be resolved easily now. What you have shown is a picture and i truly believed that it could the phone you buy, but this is done without the presence of the seller and the seller had not agreed to this action.

This action will only irritate the seller. And i am a seller and buyer by myself and i know how i will feel if the buyer complaint something but take action without my presence or agreement. There are plenty of sellers here and pls ask if anyone of them will allow you to open the phone without getting prior agreement and the seller presence.

the buyer should have requested for refund. Should have returned the phone and ask for full refund.

Repairing is always funky. Especially if it involves hp and opening it up. Usually phones sold anonymously and cheap for one reason - something to hide (eg. dropped into water). That's why I NEVER buy secondhand handphone. But that's me. Anyway...too late now. See if seller willing to refund. Even have to be more careful if it involves someone selling for friend.

I am extremely SHOCK to see when you proceed to such drastic action before getting my consensus agreement. It is not even one of my options given to you.
I will not hold responsible now as it is really fishy as why you proceed to open up the phone before getting my agreement.

its the same HP she gave me...i can prove it!! the IMEI no is match with the box...

i know, u r in her side...try to backing her rite?? i`ve been so nice to her. did even sent any treat sms/pm but she just make me lose my patient.

Just received the set from service center. all the repair cost me RM110...RM80 for the MSPD slot and RM30 for the joystick. Got 7 days warranty. This is the receipt...hopefully, she will concern. already try my best to find reliable technician, work fast at min cost.
