High Court rules Tony Pua's overseas travel ban is valid

KUALA LUMPUR: The Immigration director-general has the power to bar Petaling Jaya Utara MP Tony Pua Kiam Wee from traveling overseas due to criminal investigation.

This was the finding of the High Court here this afternoon when it dismissed Pua's judicial review application against an Immigration directive to ban him from flying off to Indonesia on July 22 last year.

Judge Datuk Hanipah Farikullah said that the Immigration director-general is empowered to prevent someone from leaving the country per Section 3(2) of the Immigration Act 1959.

Hanipah noted that the Immigration director-general issued the travel ban as he was informed by the Inspector-General of Police that Pua was being investigated for an alleged offence under Section 124B of the Penal Code.

The offence under Section 124B is for involvement in activity detrimental to parliamentary democracy.

Hanipah said that Pua also has no constitutional right to travel overseas, hence there could not have been a breach of his fundamental right when he was not allowed to travel overseas.

Funny thing is in the Immigration system says "No Restriction". Then how come cannot Fahmi cannot lepas right? Very suspicious.
