Larangan kuil baru di Perak: Diskriminasi terselindung?

Kerajaan Negeri Perak dikritik susulan keputusan untuk tidak meluluskan sebarang permohonan pembinaan kuil baru di atas tanah kerajaan bagi tempoh sekurang-kurangnya lima tahun akan datang.

Presiden Parti Makkal Sakthi, RS Thanenthiran menyifatkan keputusan tersebut sebagai amat mengecewakan.

“Apakah mesej yang ingin disampaikan menerusi pekeliling ini? Adakah agama dan budaya kami tidak lagi diberi tempat dalam pembangunan negeri? Adakah sumbangan masyarakat India terhadap negeri ini boleh diketepikan begitu sahaja?

“Saya ingin tegaskan bahawa kuil bukan sekadar struktur fizikal. Ia adalah simbol kepercayaan, pusat komuniti, serta warisan budaya,” katanya.



Thanenthiran turut menjelaskan ramai tidak menyedari banyak kuil Hindu yang kini terletak di atas tanah kerajaan telah wujud sejak zaman penjajahan British.

Menurutnya, kuil berkenaan dibina oleh komuniti pekerja ladang dengan kebenaran rasmi daripada pihak kolonial ketika itu, bagi menjaga kebajikan dan kesejahteraan rohani masyarakat.

“Kita tidak boleh mengklasifikasikan semua kuil ini sebagai ‘tidak sah’ atau ‘struktur haram’ hanya kerana tiada dokumen rasmi.

"Isu ini tidak boleh dinilai semata-mata dari sudut undang-undang tanah, tetapi perlu dilihat dengan sensitiviti sejarah, budaya, dan peranan sosial kuil dalam masyarakat Hindu,” katanya.


Tegasnya, kerajaan negeri perlu segera menarik balik keputusan tersebut dan mencadangkan agar:

Satu pelan tindakan jangka panjang diwujudkan untuk menyemak status kuil-kuil Hindu yang telah lama berada di atas tanah kerajaan, dengan tujuan untuk memberi pengiktirafan rasmi dan penyelesaian sah.

Sesi libat urus secara terbuka dan telus diadakan bersama wakil masyarakat Hindu, pertubuhan bukan kerajaan (NGO) serta pakar warisan, sebelum sebarang dasar diperkenalkan yang menyentuh sensitiviti agama dan kaum.

Terdahulu, Exco Sumber Manusia, Kesihatan, Hal Ehwal Masyarakat India dan Integrasi Nasional Negeri Perak, A Sivanesan (gambar bawah) berkata kerajaan negeri telah membuat keputusan untuk melarang pembinaan kuil Hindu baru di atas tanah kerajaan selama lima tahun.


Jelasnya, perkara itu telah diputuskan menerusi Pekeliling Pengarah Tanah dan Galian Negeri Perak Bil. 3/2025 yang memberi panduan kepada pentadbir tanah berhubung dasar bagi Kaedah Pengurusan, Pelupusan dan Penguatkuasaan kawasan Rumah Ibadat Hindu (kuil) dan Tapak Perkuburan Hindu.

Menurut Sivanesan, Perak negeri pertama yang mengeluarkan pekeliling tersebut yang turut menyatakan walaupun kuil hendak dibina di atas tanah persendirian, ia tetap memerlukan kebenaran kerajaan.

"Kerajaan negeri tidak akan meluluskan apa-apa permohonan kuil baru sekurang-kurangnya dalam tempoh lima tahun akan datang.

“Sesiapa yang mahu membina juga boleh membeli tanah sendiri dan mendapatkan kelulusan pihak berkuasa tempatan (PBT), tetapi jika ia melibatkan tanah kerajaan, tindakan serta-merta akan diambil,” katanya selepas mempengerusikan Mesyuarat Jawatankuasa Hal Ehwal Agama Hindu Negeri di Bangunan Sri Perak pada Khamis.

“Sekiranya boleh dipindahkan, kita pindahkan.

“Kita tidak mahu mengambil tindakan untuk terus merobohkan kuil sedia ada kerana negara kita mempunyai kepelbagaian kaum dan toleransi adalah penting dalam menyelesaikan masalah sensitif melalui permuafakatan,” katanya lagi.

Sivanesan juga berkata Perak mempunyai sekitar 480 kuil yang berdaftar dan jumlah itu melebihi bilangan tokong dan gereja.

Jelasnya, kebanyakan kuil ini dibina pada masa dahulu dengan kebenaran daripada Jabatan Penguatkuasaan, bukan secara haram seperti yang sering disalah tafsirkan.


Sementara itu, Naib Presiden MIC, T Murugiah (gambar atas) menyelar kenyataan Sivanesan sebagai tidak sensitif malah bercanggah dengan Perkara 11 Perlembagaan Persekutuan yang menjamin kebebasan beragama kepada semua rakyat Malaysia.

“Mengapa sekatan ini hanya disasarkan kepada kuil Hindu? Adakah dasar ini turut terpakai kepada rumah ibadat agama lain seperti masjid, gereja atau tokong Cina?

“Apa yang akan berlaku kepada kuil Hindu yang telah wujud sejak beberapa dekad di atas tanah kerajaan? Adakah kerajaan negeri bercadang untuk merobohkannya?

“Adakah keputusan dasar ini dibuat melalui proses perundingan dan dialog dengan ketua-ketua masyarakat dan pertubuhan agama Hindu?

“Sikap tidak hormat dan diskriminasi terhadap agama Hindu seperti ini tidak boleh diterima, lebih-lebih lagi apabila ia datang daripada pemimpin kerajaan yang diamanahkan untuk melindungi semua rakyat tanpa mengira kaum atau kepercayaan,” tegasnya pada satu kenyataan hari ini.

Dia turut mendesak kerajaan Perak untuk mengeluarkan kenyataan rasmi bagi mengesahkan komitmen dalam melayan semua agama secara adil dan saksama, seperti yang dijamin oleh Perlembagaan Persekutuan.

It is a columbarium and crematorium. I know 2 such places in Kedah which is smacked right in the Malay kampungs. One is quite remote but the other is in Alor Star. There was no such protests as well. Green wave in Kedah? Nah…..

It was build from the gold course or driving range. They reduce the area of the driving range, if not mistaken. Used to be a huge driving range there. I used to practise on the range.

And I don’t know if it is a church. I thought it was a common invention centre for the Christians. I can be wrong though.

We have more than enough temples of all denominations. On top of that we also have prayer halls, ashram & home shrines. The problem is Hindu Sangam is practically useless when it comes to regulating & overseeing Hinduism.

Stop bringing in pihak kolonial ketika itu. ‘Kebenaran Rasmi?’ Don’t pusing words here you ownself claimed to be. It was built part of estate workers housing at that point of employment use only

It should ceased with the plantation workers housing and all other amenities demolished once estate ownership changed hand or relocate the kuil to a private land if you care this much as claimed.

Catholic Church with many other English school premise ie convent school then and church land ownership was the only ‘rasmi’ with land deed by pihak kolonial

Guidelines & books aren't enough. We actually need properly practicing Hindus running Hindu Sangam, or any religious body for that matter. Most leaders are Hindu in name only & do not understand the philosophical basis to be spiritual guides. If you are serious yourself, then people will start to take you & your teachings seriously.
