Hi, I need some legal advice from people here who might have the same kinda experience as I'm facing right now. I don't want to disclose a lot of information so I'll narrate the situation as best as I can.

Let's say I own a land which is currently being occupied by random people. Could I cut off their electricity and water supply? I tried googling this but I couldn't find an answer, while yes it is against the law according to specific Akta but the problem is there is no contract, black and white documents where I let them occupy my land, my late grandfather let them occupy the land WITHOUT any form of documents that legally lets them occupy it. He did it out of kindness in his heart (Stupid I know) But now that I'm the sole owner of the land, I want to kick them out, currently waiting the court order to draw out the papers and notice to vacate the premise. Though that will take around 4 Months.. Someone suggested that I should cut off their power and water supply for the time being. Do you guys think this is permitted by law for me to do this considering we don't have any tenancy documents? They're basically occupying illegally without our approval.

I would also like to add that TNB had already cut off their power supply today at 1:15PM, water supply is next soon but I need some legal advice before I take things to the max. Yes the names aren't mine, but we did went to the TNB's office, I laid out all the documents, I just want some advice, basically a re-assurance that this wont bite me in the ass with lawsuits lmao.

The power aren't their names too, from what I was told, it was a deceased person's name.

Why not consult a lawyer? And pay a bit of money to lawyer to give them notice ?
*
Money's tight, paid the court fees and stuff to draw out the vacate notice and securing ownership. Mind you I'm not in charged with the proceedings I'm just helping out my family, last time I tried reaching out for a lawyer's advice, they asked me for a retarded amount of price for 5-10 minutes consultation, and the investment wasn't even worth it, the guy just gave me "Mungkin" "Boleh jugak" "Hmm boleh cuba" "Betul jugak eh" Lol.

have you made a police report stating your land is currently illegally occupied?
*
Yes, we had lodged a police report about this thing back in August 22 2023 at 2:30PM at Dang Wangi KL, we still kept the report.

Just a question - Did the people build a house or any structures on your land?
*
Yes, they built a house illegally.. My late grandfather gave them the greenlight but of course without any documents to support that because "ORang lama cakap mulut je, tiada hitam putih" Because the deceased person was friends with my grandfather. Their kids and grandchildren are occupying the land as we're typing right now.

Do u want the land?

Maybe offer them to buy the land la. U take the cash..
So u get compensated, and they get to retain the house.
*
We had tried confronting them but to no avail, their entitlement to stay there for free is beyond anyone's expectation. The reason why it took us more than a year is because we were raising the funds while at the same time waited until our grandfather passed away.

so whatever was built is now yours technically? I'm not sure but best to check with informed lawyers in this expertise.

If they ask you for compensation, you can tell them that they can air lift the whole house away at their own expense. Same principle like you're renting a shoplot and did renovations.
*
Yes, basically it's ours if I remember what my family told me when they were in court. Mind you they had stayed there for more than 2 generations of family without paying my grandfather a dime (He did it out of kindness in his heart) Now that he's gone, I'm going scorch earth on these freeloaders. I'll think about the lawyer's consultation though.

Problem is most of us don't know the whole process of eviction, most of the time lawyer is the one filing for the case and follow up

As i know lawyer file the case > obtain court order > eviction notice together with lawyer and mahkamah staff/police > then bulldoze or demolish the house

I can tell u all this require money, if u not willing to fork out money then how can u solve this issue once and for all?

P/S : One more thing, who now own the land since your grandfather has passed away? Does he pay up the cukai tanah every year?
*
Yes, he paid all the cukai, we have no outstanding balance at all.

I used the same sell the property tactic to get rid of freeloaders at my old apartment last time. Told the tenant to vacate or else the gangsters will harass them daily.

They packed up and left within a week. After several weeks later, I sold the apartment through an agent.

The fact that you had to go through this route in order to get something that belongs to you LEGALLY, shows how dumb Malaysian's laws are.

QUOTE(Syok Your Mom @ Jun 1 2025, 05:47 PM)
If I'm you I will put up the land for sale & let the developer handle the illegal settlers, unless you have manpower to overwhelmed the settlers there's nothing much you can do.
*
Problem is it's hard to find a buyer/developer that's interested in the land. Maybe if they were, they're usually out of budget even if you're being more than generous enough to lower the price for them. Buying a land requires a HUGE budget, this isn't like going out and buy Teh Tarik and Nasi Lemak. At this point, what's even the point of owning a property if you can't even get illegal occupiers to leave LEGALLY, as day goes by I'm starting to resent my late grandfather for his decisions, I can understand that maybe him and his friends were close but at what cost does it make one feel like it's worth putting their offspring in a bad spot like this? This is why I don't believe in kindness in this world, kindness in my opinion is just an excuse to gaslight themselves into believing that by doing a small act of kindness would eclipse their mass sins that they had done in their lives. Unless you're a Prophet or an Angel, there is no kindness. I'm sorry for going a bit off topic lol just needed to vent. But yeah I'll think about it though, hopefully I'll find a developer.
