 Landlord rental > Every 2 years naik 15%

I rented a 2nd floor shop lot. My landlord doesn't want to make agreement for more than 2 years.

Agreement is every 2 years and both parties need to pay the agreement fee to the lawyer (50% each). Every two years, he naik my rental fee for more than or = 15%.

When I asked if agreement can be 3 years. He pushed to ask lawyer. He said if lawyer said can, then can. I know his way la. Why need to push to lawyer.

If I renew now, next two years, he will naik for another 15%. I think this is his tactic too to stay at 2 years only so he can do so every 2 years. But it is hardly to get tenant at second floor.

Should I stay or find another? If find another, I need to pay moving and new renovation cost.

too nearby plenty of choice move out, if renovation costly just stay another 2years meanwhile searching..... which area 15% ?

I concur with this statement. If you cant come up with mutual agreement, then exit. Unless you die die want that place, then you have to agree what landlord offers. Hate to say this, but this is where property agent can be beneficial where they can find alternative when other landlord play hardball in a jiffy (with a price of course)

Definitely we will agree first before proceed to agreement. And not come with agreement and doesn't agree.

This is how the landlord plays trick, as they know the tenants need it.

If every tenants play in the role, make longer agreement and if short, doesn't rent it. The landlord with short agreement is in their favour to increase rental only.

just follow crocodile rule in trades, cut lost while you still can...
or the relocation cost more than 15% every 2 year + lawyer fee then stay.

Because every 2 years you also agree to renew, of course the landlord will continue to do so.

How's the rental rate compared to nearby lot? If it's too high then say no to the new agreement and find other places. Sure the landlord will come back and to talk you again.

it's either you have a bad payment record or your business is extremely good.
if it aint the above two, there is always a market rate. if everywhere is increasing, nothing wrong for the owner to increase. if it ain't then i don't think the owner is that stupid to demand the increment rate. finally, if both of the above doesn't applied, move out.

As long the renewed rental is within market rate, is fair.

There is a limit where the increased rental can sustain.

Your landlord is correct to check with lawyer. Cos anything longer it will not be called a rental...it become a LEASE

Nolah. 2 years and 3 years have no diff.

So within 3 years is absolute right and not fall under lease rental.

Find another unless feng shui good. There are lots of desperate landlords nowadays. Myself if good tenent, pays on time, no gibe headache, I dun increase and let them stay suka hati. Have one tenant sudah 8 years liao, another 20 years baru pindah so I can increase rental after new tenant comes.

Yes, good payment record and never owe any months. But sometimes forgot and delayed few days.

This landlord very ngio. Always chase me faster to decide if wanna renew. Then I said I can do the agreement myself and do the stamp duty at my own and he doesn't allow. He wants to use his own lawyer and the fee is about RM300. Then I have to pay RM150 (50%).

Depends who have the bargaining power.

Telco tower and their lawyers drafted every 3 years increase 15% monthly rental fee to our office building premise.

So we agree. Coz we need the passive rental income from them. No other operator coming.

If the landlord have many demand, he can demand such. You got to nego with his lawyers/agent… see how their reaction. Also find out from neighbouring shop office rental owner of the current rental Situation there.

(2nd floor = chinese calls third floor, ground floor = first floor)

He cannot just simply increase 15% every 2 years. Eventually it will be above market rate and he will not get any tenant.

I charge residential tenancy agreement more than that.


And your shop rental how much? 900? 1200?
