KOTA BHARU - Mahkamah Tinggi di sini pada Selasa diberitahu bahawa Pejabat Tanah dan Galian Negeri, Pejabat Jabatan Perhutanan Negeri serta Kerajaan Negeri Kelantan telah mengendalikan dan memindah hak milik tanah-tanah adat Orang Asli Kelaik tanpa persetujuan mereka.

Anjang Uda, 34, plaintif kedua yang memberi keterangan pada pendengaran kes saman berhubung tuntutan tanah adat itu juga berkata, dia bersama dua lagi akan membuktikan bahawa tanah terbabit telah diduduki secara turun-temurun.

"Kami juga membawa tindakan ini terhadap defendan pertama hingga ke-10, yang saya percaya berada di tanah-tanah adat tersebut secara tidak sah dan telah menceroboh tanah adat tersebut bagi tujuan menjalankan aktiviti-aktiviti komersial,” katanya.

Saksi itu berkata demikian di hadapan Hakim Hasbullah Adam pada hari kedua perbicaraan membabitkan tuntutan penduduk Orang Asli dari Kampung Kelaik, Gua Musang terhadap 14 entiti yang berlangsung selama empat hari bermula semalam.

Mereka menamakan Syarikat Perlombongan Gua Musang Sdn Bhd, Redstar Capital Sdn Bhd, Aqua Orion Sdn Bhd, Damai Corporate Services Sdn Bhd, Sindiyan Sdn Bhd dan Sindiyan Agro Park Sdn Bhd, Ladang Kelantan Sdn Bhd, Ikrar Bumi Sdn Bhd, Ladang Ulu Nenggiri Sdn Bhd, Iliasco Engineering & Construction Sdn Bhd sebagai defenden pertama hingga ke-10.

Turut dinamakan Pejabat Tanah dan Galian Negeri Kelantan, Pejabat Jabatan Perhutanan Negeri Kelantan, Jabatan Kemajuan Orang Asli serta Kerajaan Negeri Kelantan selaku defendan ke-11 hingga ke-14.
Plaintif memfailkan saman itu pada Mac 2021 bagi pihak diri mereka dan penduduk Kampung Kelaik di Mahkamah Tinggi Kota Bharu untuk memohon pengisytiharan bahawa mereka adalah pemilik sah tanah pusaka terbabit.

Semalam, Ahak Uda, 58, selaku plaintif pertama yang memberi keterangan berkata pencerobohan tanah adat Kampung Kelaik di Gua Musang menyukarkan masyarakat Orang Asli suku kaum Temiar untuk berpindah dari satu tempat ke tempat lain dalam kawasan tanah adat itu apabila berlaku kematian.

"Kami menduduki dan memiliki tanah ini dari generasi ke generasi, bukan sahaja untuk punca pendapatan tetapi juga bagi tujuan keagamaan upacara kerohanian dan perkuburan sejak turun-temurun," katanya.

Saksi itu juga memaklumkan akibat pencerobohan seperti aktiviti pembalakan, perlombongan dan perladangan yang dilakukan defendan pertama hingga ke-10 telah menyukarkan mereka meneruskan amalan berkenaan.
