 Car wrongfully clamped and damaged

My car got clamped. In my own damn condo!

Same car parked at the same spot for 3+ years. I am parked at the correct spot and payments are up to date.

Anyways, after sending me on a 45 mins wild goose chase and asking me to clarify with the management office as the order came from them, the guards admitted they were wrong and unclamped the car.

Bur the top of the clamp device bit into the car body, and it's scratched the paint off.

What can I do? Stupid fucking idiots were asked to clear another carpark but they clamped my car instead.

Do police report and pass to your management. Then get a LOD and email your management, also pass them the hardcopy

Sue the condo management. The JMB or MC will then request for discussion. State your claims clearly with quotations. If they refuse to pay, viral it. After that, sue the committee also.

They suppose to clamp another car but instead clamped yours?

Never come with warning first? Straight away clamped?

and also damage quotation (just get the quotation from SC)

They supposed to clear another car.

I don't know if they issue warning or not but I never got a call. I suspect no warning. Bloody lazy fucks.

I used the car last night all was good.

Condo management is not wrong here though. They showed evidence of the list of cars to be clamped, mine wasn't on it. Guards said they mistakenly clamped mine, supposed to clamp another car.

Normally will come with warning first. Not straight away clamp and demand payment to clear. Still want to create harmony in the community

You guys are are really funny people. Sue here and sue there. Do you seriously know how much it is to get a lawyer to open up a case and issue an LOD. Considering the damage is only a few chips and scratches on the paint on TS' car which probably will cause just a few hundreds of RM to repaint. I'm not sure if any lawyer is willing to take up the case.

Be realistic. Since TS owns a unit at the condo, he can go complain to the management or JMB and get compensation for repairs to his car.

Write a LOD is rm300 only

So include the LOD cost inside lo

Attention to JMB and the management office property manager and the security guard company.

but now bring up going to court? I'm not the TS, so I can't speak for them.

But, I would, and I have. The wind blew an unsecured roller rubbish bin, which rolled down a slope, and hit and dented my car. I claimed for everything to the MC. For full disclosure I must state that we did not end up in court, but I would have gone all the way. Why not, as it is an easy win with costs.

The MC/JMB only tries to intimidate you so that you settle for less, or give up, like you seem to want to do.

So that's my personal experience, what's yours?
