 How long can a company withhold salary [Resolved]

Left my company after serving 2 months notice last week. They told me they were withholding my June, 2 days July salary + my claims and encashed AL for LHDN purposes once I'd filled up my clearance form and gotten all the necessary approvals. Problem is that there's one person who still has not approved for some reason (no reason given) and it's been a week with no word from them. Anyone know if what they're doing is legal? What actions can I take?


Edit: they've finally approved things and I've received my salaries (tho don't have the breakdown which I'd like since I feel like they missed my encashed AL). Thanks guys for helping out!

Got such thing one? What right do they have to withhold your salary? You served your notice and left as per terms of the employment agreement.

This is what probably TS & the fella TS mentioned kena. it can go up to 3months or beyond. until the employer gets the necessary receipt from IRBM.

Your ex employer is required to withhold any monies payable to you who has ceased to be employed and they shall not pay you until they get the permission of IRB up to 90 days after submitting the form to IRB until acknowledgement of receipt.

Something to do with LHDN to clear taxes or something. I remember my first job had this also, but with them it took around a week only to clear everything and receive my money. This one 1 week also not approved yet.

Yea might be that form then. cant remember exactly which form they mentioned but I think its this. wah 90 days eh? quite long :/

yup i mean the same as M@r0R.

also, in ur case, there is july 2 days payment, and encashed AL. so all that will affect ur final pay and pcb, not only account for June only
