Demikian nasihat Hakim Mahkamah Sesyen Bandar Baru Bangi, Shahrul Rizal Majid, hari ini selepas menjatuhkan hukuman penjara dua bulan terhadap peniaga ubat kuat, dikenali sebagai 'Miza Ozawa' kerana mencari langganan untuk aktiviti persundalan menerusi aplikasi Telegram pada awal bulan ini.

Hakim menjatuhkan hukuman itu terhadap Siti Amiza Baharuddin, 27, selepas tertuduh mengekalkan pengakuan bersalah atas pertuduhan pilihan yang dikemukakan terhadapnya.

Mahkamah memerintahkan hukuman itu berjalan serentak bermula tarikh dia ditangkap pada 6 Jun lalu yang mana hukuman itu berjalan serentak bersama hukuman penjara sebulan sebelum ini.


Mengikut pertuduhan, Siti Amiza yang sedang hamil enam bulan, didakwa mencari langganan bagi maksud persundalan di sebuah unit kondominium dekat Bukit Mahkota di sini jam 4 petang, 6 Jun lalu.

Justeru pertuduhan dikemukakan mengikut Seksyen 372B Kanun Keseksaan yang memperuntukkan hukuman penjara maksimum setahun atau denda atau kedua-duanya jika sabit kesalahan.

Terdahulu sebelum hukuman dijatuhkan, Shahrul menasihati supaya tertuduh jangan mengikut perasaan dan nafsu serta jadikan kes ini sebagai pengajaran.


Hakim: Awal asal mana?

Siti Amiza: Saya asal Pulau Pinang.

Hakim: Lepas ini hendak buat buat apa?

Siti Amiza: Saya hendak buka kedai makan dekat KL (Kuala Lumpur) dan mahu jaga anak (dalam kandungan).

Hakim: Kenapa dekat KL, siapa ada? kenapa tidak di Pulau Pinang?

Siti Amiza: Saya senang cari makan di KL.

Hakim: Family (keluarga) di mana?

Siti Amiza: Pulau Pinang, KL ada kawan.

Hakim: Balik Pulau Pinang..dekat KL tiada saudara mara kan, kawan tidak boleh pakai...duduk dengan family kalau betul hendak jaga anak.

Siti Amiza: Faham tuan

Sementara itu, Siti Amiza dalam rayuannya memohon mahkamah mengenakan hukuman ringan dan tidak dikenakan penjara.

"Saya mengandung dan insaf perlakuan lama saya, dan mohon dikenakan hukuman denda dan bukan penjara.

"Saya berjanji tidak akan melakukan kesalahan terkutuk ini lagi dan mahu memulakan hidup baru, saya mahu menjaga anak ini selepas keguguran anak pertama, saya tidak boleh berada dalam penjara, boleh jadi mental dan tekanan," katanya dalam nada sebak.

Dalam pada itu, Timbalan Pendakwa Raya Nurul Afiqah Abdul Ghaffar memohon mahkamah mengenakan hukuman penjara dengan mengambil kira kes kepentingan awam dan kesalahan yang dilakukan membabitkan langganan persundalan.

"Kesalahan yang dilakukan tertuduh tidak bermoral dan boleh meruntuhkan moral masyarakat selain meningkatkan penularan penyakit kelamin," katanya.

Mengikut fakta kes, ibu tunggal itu menggunakan media sosial di bawah nama Miza Ozawa mencari langganan bagi maksud persundalan telefon bimbit itu kemudian dirampas dan media sosial dikenalpasti untuk dibuat semakan Suruhanjaya Komunikasi dan Multimedia Malaysia (SKMM).

Pegawai penyiasat kes melakukan semakan SKMM dan mendapati tertuduh menggunakan Facebook dan Telegram untuk melakukan kesalahan itu, manakala media sosial berdaftar atas nama Siti Amiza Baharuddin.

Minggu lalu, Siti Amiza turut dijatuhi hukuman penjara sebulan dan denda RM12,500 oleh Mahkamah Majistret di sini selepas mengaku bersalah memiliki bahan lucah dan ubat tidak berdaftar tanpa kelulusan Kementerian Kesihatan Malaysia (KKM) pada tempat, waktu dan tarikh sama.

Pada 14 Jun lalu, Harian Metro melaporkan dua gadis tempatan bawah umur berusia 12 dan 17 tahun, antara lima individu yang ditahan di Kajang pada 6 Jun lalu kerana disyaki menggunakan media sosial untuk mempromosi dan terlibat dalam aktiviti persundalan.

Siasatan turut mendapati kumpulan itu mampu menjana pendapatan sehingga RM20,000 sebulan daripada hasil kegiatan pelacuran dan penjualan produk seks.

I went to court once for Tuntutan Kecil. Its basically for someone who owed u money and not paying back. I requested the judge to order the defendant to settle it one lumpsum as he have history of running away and not paying, however the judge say its not in her power to determine if he is capable to do so or not. So the judge ordered the defendant to pay me Rm500 monthly until finish.

The defendant didn't even pay anything after that, so I have to go through the same process again. But this time during the hearing, I specifically told the judge its not at her best interest to decide what's the best for the defendant, but for justice. This was the advice issued by Sessions Court judge Shahrul Rizal Majid after sentencing a woman to two months' jail for soliciting for the purpose of prostitution earlier this month.

The 27-year-old woman, Siti Amiza Baharuddin, also known as 'Miza Ozawa', had pleaded guilty to the offence last week.

Shahrul Rizal: Where are you from?

Siti Amiza: Penang.

Shahrul Rizal: What do you want to do after this?

Siti Amiza: I want to open a restaurant in Kuala Lumpur and take care of my baby.

Shahrul Rizal: Why Kuala Lumpur? Who do you have here? Why not Penang?

Siti Amiza: I have friends here.

Shahrul Rizal: Go back to Penang. You have no relatives in Kuala Lumpur, and you cannot rely on friends. Stay with your family if you really want to take care of your child.

According to the charge sheet, Siti Amiza had solicited online subscriptions for the purpose of prostitution.

She committed the offence about 4pm on June 6 at a residence in Bandar Bukit Mahkota in Kajang.

The charge under Section 372B of the Penal Code provides for a jail term of not more than a year or a fine, or both.

Meanwhile, Siti Amiza, in her appeal, asked the court to impose a lenient sentence and not to incarcerate her.

"I am pregnant and I regret my past actions. I plead for a fine instead of imprisonment.

"I promise not to repeat the same offence and want to start a new life. I want to take care of this child after losing my first one.

"I cannot be in prison as it could affect my mental health and cause stress," she said in between tears.

Deputy Public Prosecutor Nurul Afiqah Abdul Ghaffar pressed for a deterrent sentence due to public interest and the nature of the offence, which involved solicitation.

"The offence committed by the accused is immoral and can undermine societal morals, in addition to increasing the spread of sexually transmitted diseases," she said.
