11 Days to be Observed. (Five days compulsory and six days elective)
Public Holidays in Malaysia)


Recently, employers in Malaysia have expressed concern over the manner of announcing spontaneous public holidays on short notice. All these public holidays are listed in the First Schedule of the Holidays Act. The following are the ten specific public holidays stated in the schedule:

However, it should be noted that in Johor, Perlis, Kedah, Kelantan, and Terengganu, New Year's Day (January 1) is not a public holiday, while it is a public holiday in all the other 8 states in Malaysia.




However, in Perlis, Kedah, Kelantan, and Terengganu, Hari Raya Haji goes on for two days, while in most of the other states, it lasts for a single day.



State Holidays and National Holidays
Public holidays in Malaysia can be classified as the state or national ones. The above-listed official holidays are usually observed not only by the governmental structures but also by most commercial organizations.



While Malaysian states also observe state holidays as per section 9(1) of the Holiday’s Act, depending on their significance to the respective state.



Take for instance, Kuala Lumpur, the capital city of Malaysia and two other federal territories namely Putrajaya and Labuan celebrate together during the yearly Federal Territory Day held on February 1st.


In addition, this celebration is required by Section 9(2) of The Holidays Act.



11 Days to be Observed. (Five days compulsory and six days elective)


The statutory public holidays that every employee is entitled to as provided for by Section 1 of the Holiday act (Section 8 of the Act and section 60D of the Employment Act) include the 11 gazetted ones and any day specified as a public holiday.

Employers are not required to observe state level holidays. If employers do not declare such state level holidays as paid holiday; hence, the employees must work as usual for the days.

However, there are several exceptions like Federal Territory Day that should be strictly observed within federal territories (KL, Putrajaya and Labuan).

In other states, the Ruler’s Birthday, also known as the Yang di-Pertua Negeri, should be commemorated.

Section 60D requires the employer to give a list of 11 gazetted public holidays to which employees are entitled before the start of each calendar year, 5 of which must be:

This provision empowers employers to designate whether employees should work on specific occasions such as Chinese New Year, Hari Aidilfitri, or Deepavali. It is important to highlight that employers are required to specify the 11 officially designated public holidays.

The Minister has the discretion to declare additional holidays.

The Minister has the mandate of coming up with additional public holidays, as per Section 8 of the Holidays Act. The provision empowers the Minister to declare any day a Public Holiday in the Peninsular, Federal Territories, or certain States following consultation.

Surprise public holidays declared by the Malaysian government in 2021-2023:

However, it’s important to mention that the Employment Act is applicable only to Peninsular Malaysia and West Malaysia whereas labour legislation in Sabah and in Sarawak prevails separately.


Is it within legal bounds for an employer to mandate that employees work on an officially declared public holiday?

Section 60 Employment Act


Regulation Requirement

Section 60 of the Employment Act An employer can request an employee to work on a paid holiday.
Public holiday pay The ordinary rate of pay on public holidays should be at least twice the ordinary rate of pay on working days.
Overtime pay rate Shall never fall below 3 times the rate of pay during working days.

Section Provision

Section 60D(3)(b) If an employee works on a holiday and is entitled to a travel allowance per their contract, they should receive this allowance. Additionally, any housing or food allowance should be increased accordingly.






Does this mean that private sector employees are only entitled to 11 public holidays per year, while government servants have around 19 public holidays?


Do MNCs in Malaysia give all 19 public holidays to their employees?

Do staff at 7-Eleven, Mr DIY, Senheng, AEON, fast food chains, Shell, Caltex, Petronas, BHP, and Petron receive 11 days or 19 days of public holidays?

Bank, insurance companies, mutual fund companies, official car dealers, and post office staff surely get all public holidays.

Developers like SP Setia and Eco World also open on public holidays.

So not all developers staff rest on public holidays.






But there is a replacement holiday for Sunday if a holiday falls on Saturday in Johor state, because Johor's rest days are Friday and Saturday.

If the employer declines to grant the employee leave, they could face repercussions or penalties.


Malaysia’s Employment Act of 1955 requires employers to give employees leave off for all public holidays. Failure on their part to give leave attracts hefty fines amounting to about RM10,000 and/or six months imprisonment.

Furthermore, employers could face other consequences such as drop in employee morale, loss of productivity, increased employee turnover and negative image as an employer.

Conclusion

There are 11 paid public holidays and employers usually select 6 out of 11 public holidays but ministers can declare additional special holidays from time to time.

On the contrary, employers are free to choose a different day to observe holidays which they may not be able to do on short notice. Where employers force the employees to serve on this minister’s announced holidays, they will have to be paid according to the public holiday rate.

which not suitable for book printing...
and everytime whole artwork need to readjust/edit cos all text/etc is at the edge,......
and customer just pass the file and missing...
i complaint many time, boss just say...
print nia, cheap job...

mine MNC but only observe 11days, so yeah, my previous jobs some MNC some local company, observe all PH, including festives ones....

depends on whether worth it a not, if give u 19days PH, salary like shit, also no use, for 11 days PH, but salary not bad....

Saturday - off day (typically). Depends on company.

Sunday - rest day (typically). Your true holiday.

Shift workers off/rest day? See the rooster. When drafting the rooster, HR or operation will have a say on it. But typically we leave it to Operation to control.

Small drama is who get holiday cause some ppl want off, some ppl want more money.

Kedah, Kelantan, Terengganu and Johor? trying to make the world disorganized only.

But then it makes one good economy sense, save 2 hours of working time on paper. But from what i heard, States with Thursday last working day, then civil servant is basically off one hour earlier, or even not operating after lunch. Move the "Friday" to "Thursday".

Kalau orang tu malas, memang malas la dia.

Bank Rakyat was established in September 1954 under the Cooperative Ordinance 1948, following an expansion of the cooperative movement in Peninsular Malaysia.

To facilitate the expansion of the cooperative movement, the co-operatives set up their respective union banks provide financial needs to their members.

In 1967, Bank Kerjasama Malaysia Berhad replaced Bank Agong with its membership opened not only to the cooperatives, but also to individuals.

On 6 January 1973, the name was changed to Bank Kerjasama Rakyat Malaysia Berhad or better known as Bank Rakyat.

Bank Rakyat is governed by its by laws and Bank Kerjasama Rakyat (M) Berhad Act 1978 (Special Provision 202), which allows Bank Rakyat to provide financing to non-members.

In 1989, Bank Rakyat was placed under the Ministry of Land and Co-operative Development and the Ministry of Finance.

In 1993, the Cooperative Act was reviewed which allows the Bank to operate in Sabah and Sarawak.

On 8 May 1993, Bank Rakyat took a giant step towards becoming a syariah co-operative bank by introducing Islamic banking products at four of its branches.

Bank Rakyat became a full-fledged Islamic cooperative bank in 2002. Hence, with this major decision, Bank Rakyat marked another milestone in history where it became the third bank to offer total Islamic banking products in Malaysia.

Yea, the history highlights it is allowed for non-members via act.

Erm... maybe koperasi has very different operations where members are more active with the management.

Cause the insurance is afterall, for the case of bank tumpang.

They will say, you believe us, you put lo.

If you dont put, i will just service my own koperasi members will do.

Initial 8 9 July have both replacement holiday with memo issue.

Now rumors many bank are cancelling. Only 1 day given.

My friend working other bank said received memo to cancel Tues JULY . Sad

Previously, when two holidays fell on the same day, and it was also a Sunday, did Malaysia have a replacement holiday for two days?

So far seem not encounter
Cause last week we received replacement for Tues from HQ. Via Malayan Commercial Bank Association.

Then now issue annulment of public holiday. Haha 😭

Penang heritage day is declared by state under holidays act. That's why won't get replacement. Ur hr confuse then someone clever pointed out I guess

But the rest 6 days is just normal pay.....
And can't choose on public holiday....
Only can choose on other date.....
