In a nutshell.

Selamgor EXCO from DAP says no problem appointing the company owned by husband of DAP minister because the company was already approved by APAD, an agency under another DAP Minister.

APAD is under Ministry of Transport Anthony Loke.

In fact, APAD was created by Anthony Loke in 2018 after SPAD was abolished.

SPAD was previously under PMO then when abolished and replaced by APAD by PH1.0. APAD then put under Ministry of Transport.

If like that then no need talk lah. Minister can easily tell them, go approve that company.

At the end of the day, it is all about public perception.

And now the public perception is like this:

Can but not tender related with gov

Nope. Actually the latest court decision in Oct 2023 is that govt was at fault and said no misuse of money.

"Justice Anand Ponnudurai ruled there was no wrongful use of the RM250mil loan sum and no breach of fiduciary duties by the 11 defendants

The court also found that the Federal Government had breached the Implementation Agreement (IA) when the plaintiff failed to construct the Export Quality Abattoir (EQA) and breached the Loan Facility Agreement (LFA) by unlawfully terminating it.

Justice Anand pointed out that it was not unlawful for NFCorp to utilise part of the loan sum to invest in properties in the name of the company and the company did not breach the loan agreement and IA.

The court ruled that the project’s targets were not met due to the government’s failure to build the EQA..

The court also allowed NFCorp’s counterclaim against the government for breach of agreement and allowed for nominal damages of RM10,000.

Both the govt and NFC are not appealing that decision.
