 Tenant refuse to move after contract ends, Trusting the wrong person....

Long story short ...

My father had a Double Storey Terrace in Johor Bahru since 1983.
All along he trusted a relative's brother let called him Mr X who is staying in Johor to manage any tenancy or issue with the house.

Recently, we decided to sell the house as the tenancy agreement ends on 31 Jul 2024.
Mr X said we will need to provide a tenancy ending agreement for the tenant which we did.

In May 2024, we were inform by Mr X that the tenant wants to continue to stay here citing he had renovate the place which we are unaware of.
We ask Mr X for the tenancy agreement and he start to get agressive saying he had been helping my father for so long and the tenency contract had several pages.
Starting to act gangster against my father.

I strongly believe he had pocket money for all these years(30yrs) and yes, blame it on father for not asking for all these basic paper work.
A double storey terrace for rm800 in johor bahru, tampou area. can you imagine for 30 yrs.

So the question is, if we do not sign any more renewal contract, the old contract will lapse and end by it own on 31 Jul 2024.

If the tenant is still staying there without a new contract is consider illegal occupying right.

A lot of pple said calling police is useless as they will just record and nothing done.

Engaging a lawyer is exhaustive too, cost money and takes a long time and no one will be knocking on their door to ask them to move.
So even if lawyer letter is out and they still ignore. We cannot do anything right?

Are there company in Johor that helps to handle such things. Can PM me as i really need help on this

Contact the tenant directly. If no contact number, go there to talk face to face nicely. Tell them that u guys are the real owner and want to sell that house.

I'm afraid that guy X not even pass the ending agreeement prepared by u guys to the tenant.

By law, owner can just sell the house and give example 3 months notice to the existing tenant to move out. Or, sometimes, the tenant themself willing to purchase the house.

Doubts cleared up as the tenant contacted me. The contract stated an amount and the middle man "potong" rm50 as well as the deposit.
Tenant now chasing the middle man for the deposit and the middle man pled us to go down and witness the handing over as the tenant is pestering him. Serve him right. but we did not do so as we are not staying in Malaysia.

The tenant now give excuses of his family used to the area, children studying nearby etc and want to continue to stay here.

The last text agreement in May 2024 that we had is we will compensate him rm2000 and his last 2 month rental will be deducted from this rm2000 when he return the house on 31 Jul 2024.

But start of June 2024, he message again and asking to stay till end of this year so his children can complete their study.

We replied no to him as we have given him so many chances as he always change his mind.

in the event 31 Jul 2024 and he is still there and refuse to move, what can we do.

I have done my research and people are suggesting :
1) Change lock (illegal)
2) terminate water and electric ( they can apply to turn on)
3) report police (report only they will not do any thing)
4) cut lock and go in (illegal)
5) engage lawyer ( rm7000-rm25k(if contest), time consuming 6 - 9mth)

Is there anyway to get tenant out. Law only protect Tenant.
