i faced with the same issue, and have consulted a few lawyers. Unless they have assets, and "planning to close down" there is nothing can be done. Unfortunately, mine was right before CNY

after closing down can that same person open a new company again using his name?

yes he can but your employment agreement is with the current company which is closing down.

closing down without paying the salary, can be the way employer run away from the obligation?

It is useful. Closing down a company is slower then opening a company.

If they are out of funds, you can sue them until the end of time also you wont get anything off them. Companies are separate entities from the owners.

dont think they out of funds they just dun wan to pay. he just pay cut me 1k+, lol

my tip is dont join such company. always make sure the company has an office in KL. I consulted 2 lawyers both gave me different answers. After i visit JTK, and u see how the officers there work, u dont feel like wanna go with the complaints anymore.
