Don't count on the lottery; it really is a random selection.
I'm confused to you mentioning it as the lottery application is only open in October - November of the year
But from what I understand, applying for the lottery has no effect on any other visa application

Your best bet would be to be sponsored for the H1B, or go through the 1 year for the L-1. USA has the rules stated, and they follow it.

I also confuses. US HR also told me we will know the lottery by the end of this month.
I wonder if we are talking about the same thing?
H-1B Visa - Company hires a specialist to fulfill a special job no one else can do (maybe have some leeway here they can show that you are very suitable for their position with your experience)
L-1 Visa - Company transfers an employee internally to USA (makes sense you have to work 1 year for the company in Penang first)
Diversity Visa aka "Lottery" - Totally random selection to increase the diversity of people in USA. Anyone can apply, absolutely no guarantee for any outcome.

Just let you know that I am not even close to an expert, just that I have checked on all the visas before. Every year also I apply for the Lottery see if have luck. But even if you strike the Lottery visa, it still takes at least 1 year to be granted. That is where I am wondering why the company is hoping on the Lottery visa.

Good luck. Remember the past but always look forward.

Edit for grammar

I think I get it now. The H-1B visa is also granted on a random basis, so you are using "lottery" for this, while I am referring to the Diversity Visa as the lottery.

I read that H-1B is initiated by the employer, and is open now. You also need to register an applicant account, and work with the employer on this.

Then no choice, gotta work in penang for the L1 visa.

H1-B is not assured and subjected to caps

I think this is the absolutely correct answer. Work in Penang, but also try tikam for the H-1B

There's a risk to that. 1 year is a long time in corporate timescales, business conditions can change very quickly, banks got brought down over the weekend.

You may be hired with the verbal promise or understanding that they will petition for your L1 visa upon fulfilling one year of service....guess what, when the time comes, the company could be acquired, a freeze in hiring, layoffs, delays in recruitment, reorg, divestiture, that director of yours left for something else....a lot of variables for one year, it may not happen at all

Also understand that you'll be getting a penang pay..........even if they gave you something in the teens, that's poverty level to super entry level pay in the US

you could insist on having this transfer in your employment contract though really, if it doesn't happen, will you have the resources to take this company to court, presumably in msia or the US?
But what other choice does TS have? (Assuming TS really wants to work in the USA) Ultimately all depends on the employer to do.

If there's a way, best is still to be based out of Canada, be a contractor or something

This is what I would choose, but TS questions are on the visa to go USA.

It's almost 1 year since I'm working in Penang and I'm going to follow up regarding my visa application process.

Before I ask my US immigration attorney (Fragomen) or my boss I'm trying to understand the requirement stated on uscis website which state for me to qualify the L visa,

"Generally have been working for a qualifying organization abroad for one continuous year within the three years immediately preceding his or her admission to the United States; and"

I need to work continous 1 year or can staggered within the recent 3 years? Or I work 1 year then quit but I still can apply the visa within 3 years I quit?

By the language I think it is this
