 Part of our land was used as public road.. how?

Hi, need you guys advise.

My family have a old semi-D in KL, according the pelan tanah, there's a long driveway (about 1000 sqft) in front of my house's main gate that's part of our land.

However, since my family didn't cover it with fence, the road has been used as a public road since many years ago (and 10 years ago DBKL come put the asphalt). The road in front of our house is actually one-way road (enough to fit one car), but because they used my driveway, so it become two-way (enough for two cars).

Because it has been like this for many years, so I don't think I can take it back to make fence, and it is not nice to neighbours too. So, can I get some compensation from Government as that piece of land is belong to my family and now has been used as public road?

Any input are welcome, thanks a lot!

Report to DBKL & KL land office...
U got case to get some compensation....

Have you appointed a land surveyor and got all the proof that the road is encroaching on your land? Then hire a lawyer and make a lot of noise. Then only maybe DBKL may decide to use the land acquisition act to acquire your land. But expect this to take many years

U need to do some drama and make it viral like taman desa corner lot case..

But first, u need to get ur fact right and certain.. which is to hire land surveyor to do measurement

maybe even the DBKL dont know it's a private road, the worker just put the asphalt on the space without space and thinks it a road.

just make a report and follow up.

i heard there a case where a condo occupied a private land and claims to be them, the road served as a main entrance to the condo, end up the condo have to pay rental fee to the owner .... feels bad for the condo owner because this clearly is the developer's fault for not design properly, ending up need to paid by the owner.

Local authority only construct road according to surveyors marking. very likely part of the private driveway was on gomen land.

Land title and surveyor could mark boundary of private property.
