I believe other HDD manufacturer are very aware of this on don't want put themselves into trouble. The only thing I can say is that people nowadays like to sue for anything and everything, to the point that sometimes it can be so ridiculous. That's why in the US, lawyers are a dime a dozen.... no offence to any lawyers here...
