 No CF/CCC, CF or CCC

Hi there

I have a 35yr old leasehold property in BB Bangi bought 15 years (subsale, not from developer). No CF/CCC was given to me then. I have found a buyer for the property but the buyer would not proceed without a CF.

I asked MPKJ for a copy of the CF and their official response, was that "Salinan Surat Kelulusan dan Salinan Pelan Kelulusan Bangunan tiada dalam rekod jabatan".

My property is a 2 storey rumah kedai and is an intermediate unit of a 10 units block. I heard that I will need to get a consultant to do a as-built plan - I dont know iif the entire block of 10units will need to be reviewed, or is it just my unit? What costs am I looking at?

Are there any other options?

Find out who is the developer and architect (who would have certified the CF) at that particular time. If they exist until now, you can get a copy from them.

Else ask your neighbouring shoplots and see if they have a copy of CF since the CF will be the same for all the lots (or at least few lots at one go).

how come no copy of CF?
what document u send to them for that application?
i think MPKJ 4th floor or 7th floor for the CF copy right?

I shall ask the developer but expecting the response that its a 35yo building and they wont have the records anymore. I have asked the neighbouring shoplots and all are scratching their heads, but will keep asking them to search if they have a copy, and praying hard that they will share. Thanks

Their form requires cukai taksiran, geran, cukai tanah and gambar bangunan, which I have submitted, and paid the RM100. Its hard to believe that they dont have a copy on record. I believe its on a dusty file somewhere that is not digitized?

Thats why I have to find an alternate way to get the CF because surely there can be no handover to the owners without a CF even 35 years ago!

Your buyer trying to lowball on you. If you are not in the rush to sell, just ask the buyer to fly kite.

35 years ago, it was known as the Certificate of Fitness (CF). CF was issued by the PBT , in your case , it should be MPKJ. Only from year 2007 onwards the practice was changed to CCC ( issued by Architect ).

If the Developer cannot obtain the CF 35 years ago, no way they could do vacant possession.

Unreasonable buyer imposing unreasonable rules to their liking.

not really lar...sometimes they really need because when apply business license...MPKJ need it..
lately i only know town council want things like that for business application.

Building with no CF is not surprising then.

Sometimes the landowner has not conform to planning permission and hence the Majlis refuses to issue the CF.

It may not be related to the safety of the building but other issues.

Meanwhile, the landowner will deliver 'VP' to buyers and he will follow-up with Majlis requirements to get the CF. The Majlis will have no objections.

If he don't do it and buyers don't follow up, cerita closed with no CF.

Same with Strata Title then.

So is not only your case but many.

Also for building extension planning permission. This is one reason some do it illegally for failure to comply.

but i thought normally we dont ask for a CF/CCC ? unlike those who do extension, then we ask for local council approval only...

If nothing happens, CF or CCC is not important.

If natural disaster strikes, the insurer may ask for it and if cannot produce, then the 'slashing' compensation can work in their favour.

I am just guessing and it should be the same as motor policy where the owner must produce a valid road tax and driving licence in the event of a claim.

Of course, if one don't buy insurance for a fully paid property or a motor, then that is also not a concern.

Some banks require a copy of the CFO or CCC for drawdown of loan. Apart from that (other than needing it for renovation/ license approval), there is no need for CFO.
