I've mentioned this before but substitute that motorcycle with your own car & that BMW rammed into you. Will you tap the BMW owner's shoulder & say "hey, I know I'm also at fault so let's share the car repair fees 50/50?"

If you have to add "victim should have / would have / could have" then it's no different than saying that the victim did contribute to the incident. You can play around with words & I know where you're going with the video about bad decisions but you're still putting the victim on the spot where the incidents should have / could have / would have played out differently if she did something else than what transpired on that day.
