I need some help/advice and here is my long story short....

I have been working in my current company for 7 ++ years and found another job which pays better and better job scope. Tendered my resignation to my manager and they are very sad to see me go however understand that it was needed for me as there isn't much career progression for me already in the team.

While serving my 2 months notice, there was another internal job for another department which I was interested and is 1 grade above my current grade. Was told by my awesome colleagues to give that new internal job posting a go and see if they can pay me more and get 1 grade higher if I were to stay back, after all there is no harm in trying right? So I decided to give it new internal job posting a go while I still have 1 more month to serve left. Even spoke with the hiring manager about my interest and told him my current situation that I have resigned and if he wants to try me out, he and his team have to be fast in the interviews. Have gone through 3 initial interviews will multiple folks, and now I am at the final interview where they will probably talk if I really want to proceed with this internal role and what kind of package will I get by joining his team.

Now the questions I want to ask is:

1) If I do accept the internal job posting, is it "legally" okay to call up the other company that offered me to join earlier and tell them "sorry can my current company gave me another role and I will not be joining you all in 2 weeks time" ? I've been reading online a little and some said so long you do not turn up on your first day of work at new place, you are not employed with them yet.
2) Will the other company take legal action against me as I have already so called "signed" the offer letter that I will join them?

My manager is a very cool guy and he can retract my resignation letter anytime so long I am still employed with him, but he will only do it if the other internal department confirm wants me. Also the last interview with the internal hiring manager and from me joining the other new company is just 2 weeks gap! If I do get to the point where I do want to stay at my current company but joining another department instead, I really might consider (provided they can match my new salary at a minimum and give me 1 grade higher). If that happens, probably I will be black listed from joining that other company forever.

What are your thoughts? I've never really been in this situation before in my 18 years career. The real question I really want to know is, is it legally okay to reject the new company offer even if I already sign all that I accepted the offer!

Looks like you're trying to see whoever can offer a better renumeration package.

I like the current company, the new company that I so called will be joining also is a big company which I not mind joining as well if there was no better internal transfer post. In a way you are right, I am thinking for a better package if possible and I know that new internal department can pay quite well (if they want to give) and has better career progression. So is the new company as well.

Since I already at the final stage, I will see what they give me and if I accept the internal job posting, I am trying to think of a way to tell the other company that I have wasted their waiting time by offering and then hope they cant press anything on me. I am not the kind of guy who wants to give bad news / reject offers but sometimes one have to look out for ourselves in terms of self interest.

Yes, you can reject a job offer even if you have signed the offer letter, as long as you have not officially joined them for first day of work.

Of course, they will not be happy and may blacklist you, so the decent thing to do would be to inform them early so that they can find a replacement asap.

In my years of work, I have been ghosted quite a number of times by candidates before, haha..The worst are those that only informed us on the day that they are supposed to start work.

I have the same issue last year. I told the new company that I will taking the counter offer from my current company. All is good. I think the key is to tell them, don't ghost them. I think...

in my previous company, we have had people who had cold feet literally just days before first day of reporting to work...

Just wanna ask, if you got the internal job, do you need to have probation again? However your leave and other benefit?
Would it be like a new employee if you get the internal job?

For me no probation. Straight join other team, just need to learn the new department SOP again.

Also an update on my end, I was offered the internal role just 1 week before my last day in the current company. Took me 24 hours to think about it and then I finally took the offer from the same company. Monthly salary wise isn't as high as the other company offer but my bonus and shares option changes as this is one level above my current role. which was alright to me as my service with the company continues. Told the headhunter that I will not be joining the new company in a week time and they just told me to draft an email to them so they can pass the message to the other company to end terms in a good way (I hope so).

If pay is good (even miss out by a few hundreds compare to other company), and higher grade, then stay on the same company.

18 years of career sounds like you are in late 30s or early 40s. Best to stay on, unless you are so over the current company that you don't give a shit and just want your own life or more challenges in other company.

2. People accept n rescind offer acceptance. This is HR/TA life. No such thing as you being banned from all company. That one company maybe but not other companies. He'll Companies es also can rescind the offer they gave to you as long as before employment contract is signed!
3. Ensure that you have an internal role signed before rescinding your acceptance.
