Just would like to know if a company is giving MSS. Would the contract staff be given priority vs permanent?

QUOTE(zombie24 @ Apr 17 2023, 08:33 PM) Its all in employee handbook when it comes to dealing with staff or malaysian lawNormally contractors will go first then permanent In my view ans in today society, company will not want to terminate permanent but will find way to either make him resign or get non performance If they target you, you play smart la ha As for contract, its clearly stated in your terms of contract. Either party may end the contract with a written notice ( and the notice period which is usually 1 month to watever) |

Contract staff usually in contract it already written there is notice for either party to give notice to end the employment. Example 1 month notice, mean employer have the rights to terminate your service by giving 1 month notice or employee resign and serve 1 month notice within the 1 year contract tenure. Theoritically there is no priority of retrenchment for contract staff. Unless company is going to terminate your contract immediately and quit within 24 hour, then you will get pay of 1 month salary as compensation.

If you are good, they will retain you even though you are just a contractor.
They might even convert you to permanent. |

Effective 01 January 2023, all employees, permanent or contract staff are entitled for RETRENCHMENT BENEFIT in accordance with Employment Act. This is in addition to notice period that must be given by employer to employee or cash in-lieu if without notice.

Still remember last issue on news that hundred of government contract worker termination and they did protest but at the end no one would layan them.
Why? because of contract TnC has clearly stated. You signed on it mean you had agreed whatever written in contract Black and white. Company would give VSS or MSS to contract basic worker. |
