 Car Accident Insurance claim, Please help

2 weeks ago, my car kena langgar from the back at the north south highway, did my police report nearby at Kuala Kangsar. Waited 2 whole weeks from the Sargent to do my report.

The thing now is, for the Ori copy I have to go back to Kuala kangsar to get the report while right now I'm in KL. I called up and ask if I can send wakil to get it for me and I was told that I need to write a permohonan letter and mail to them, this process takes up time for them to confirm, so the wakil have to run twice to the balai just to get the report, plus I don't have friends that stay in Kuala Kangsar to do it for me I need to ask someone from penang which will be very inconvenient.

If I do it myself I have to run twice also first time just to buy the report and wait for them to process and then go again that's what the police told me. So the question is, is there a time limit for me to claim third party Insurance? Usually how long is it?

I haven't sent my car to the workshop yet because I need the Ori copy, can anyone tell me if they can accept just the salinan? So that I can just get it from nearby police traffic.. if anyone has good workshops nearby PJ can recommend me as well. This was my first time kena accident so there's a lot of things I'm still learning. Hope sifus sekalian can give me advice. Thanks!

Why are you doing all the legwork? Send your car to authorized service center or panel workshop, give them a copy of your report reference and they'll handle the rest.

TS, what you need is salinan ripot, enough to get in touch with your insurer and send into workshop.

I was in your shoes before; i waited for investigation result for a month before sending my car to workshop to claim the other party's insurance through my insurer. long story short, if you send it too late, insurer might refuse - how can adjuster ascertain whatever damage you appear to have incurred is from THAT accident and not from subsequent accidents that you hid from insurer?

Workshop helped me to write letter to insurer, explain why i sent it a month after, and just like you, it was due to waiting waiting waiting waiting for the investigation result.
(yeah, without investigation result, supposedly the insurer and repair won't proceed even if i sent it aright after the accident; incomplete document.)

and the fucking thing is, the guy who damaged my car was driving his brother's car AND unlicenced at the time of driving, so insurer of the real owner refused to cover. i just received letter from that insurer to explain so after 1.5yrs.

yeah, like the others said, no need for you to do all the work, or maybe because its a 3rd party insurance?

Yea.. I'll send it to the workshop first and see how it goes. But the thing is I wasn't sure what's the person insurance, I've to get to the correct panel workshop isn't it? I asked for the sargent help but she told me that's not her responsibility. Can workshop help me to find it out?

Woah man what made them took so long to find that out and tell you? Yea.. it's a pain in the ass to find it out later that the person doesn't have insurance or expired for you to claim. That's why need to check the person driving license and road tax during the incident. Well, lesson to be learned I didn't check those details as well because I didn't know in the first place what I get is just the plate no.

Yeah usually it's more troublesome to claim 3rd party.. I was told that most workshops need you to get the original report that's the issue if it's salinan I can just get it nearby...

according to seargent, it is correct that all parties need not reveal IC/license to each other. PDPA maaaa. i kena "scold" by seargent when i complained that the other side refuses to reveal. not your responsibility to check who is insured, licensed, and taxed.

i only got to know the other person was not licensed when his sister called to settle outside. the moment it was revealed he is not licensed, the more incensed i became; you go against law and you expect me to play ball hide your offence outside Court?

(last i heard the driver was compounded for other than unlicenced offence. wtf way to bury it. but i did not chase the matter lah.)

talk to workshop. can claim through your insurer. i claim against my own, and my insurer will claim from the guilty's insurer. that's why the investigation report need to determine who's at fault. though in my case, since the guilty's insurer refuses to cover, it only ended up brick wall at claiming mine....

One more question, if let's say the workshop is not listed in the third party panel which I checked in the website's pdf but is a really good workshop, by any chance if there's still a possibility that they can help claim it through the third party?

Your best bet is to call the workshop and check if they are panel listed under the insurance company.
If not, then better proceed with panel workshop.
Anyway if your car is below 5 years old, just send to your service center. You'll be assured of quality service and genuine parts.

Most insurance claim is under OD-KFK because it's faster, means you claim your insurance first.
Then wait for police result to come out, if the police result favors you, you will not lose the NCD. Your insurance company will make claim against the party at fault's insurance.
If police result come out favors the other party, then say bye bye to your NCD.
