We're a single-storey terrace house taman in KK, Sabah (stayed here more than 30 years d). My neighbour is the corner lot, with quite big space. So, they want to renovate to put in another floor. Apparently their contractor was the one who got the approval for the reno.
However, some people are telling me that they should get my approval first, since I am the neighbor. No one has approached us so far.
Anyone knows what's the procedure like?
Thanks!

based on what i read somewhere, they should ask your permission and sign some agreement, if they cause any damage on your property, they are supposed to repair it or something like that... i could be wrong...

From what I read your neighbor need to apply this --> https://dbkk.sabah.gov.my/index.php/en/perk...naran-merancangI don't see any part that requires approval from you as an adjoining neighbor. But I am no expert in this. My suggestion is for you to contact and ask directly via https://dbkk.sabah.gov.my/index.php/en/perk...ggan/aduan-awam

not all councils require consent from immediate neighbours, however only architect/registered draughtsman can get approval for any reno works... not the contractor you can refer/inquire to DBKK - jab. kawalan bangunan if there is any issue

No adjoining property owners can deny another from developing or renovating his property if approval is given by the local authority.
If the neighbour is affected, he can lodge a written objections to the council with valid reasons.
Unforeseeable damage is not a good reason to object.

I'm not against it, but I need to protect myself too since our house is adjacent and they are building one storey up.
Nanti my house retak here and there since i think they will need to put in new beams and etc.
Thank, will try to ask DBKK.

Hmm... There's any issues with your house.. Report to the neighbor & the contractor....
If they ignore & don't give damn..
Report to DBKK... Stop work order sure being slapped 👍 Unless that neighbor have big ass cable connection.... Then good luck...

QUOTE(colloncream @ Jun 8 2022, 11:20 AM) Yeah, i heard this too, dunno how true only certain case require, before the local authority approval. Since your neighbor already got the approval, then this step is not necessary. If your house crack due to neighbor's renovation then you only complaint

When I applied for renovations permit last year, the form does have a section for immediate neighbors consent. It was MPS though so I'm not sure if different authority have different requirements.
Better check with your local authority, who knows they kawtim and fake your consent.

Get their contractor or yourself to do 'dilapidation survey' and get the report for your safekeeping. Any crack in the future you can claim from them.
