 Tenant is not co-operative

Hi all,

So I have been trying to assist my parent to sell off their house, I am alone in KL and my parents are in hometown.

I have this tenant that have been renting with us and have also been paying the rental promptly, so there is no issue.

Now, the problem is, because we wanted to sell the house, so the agent would like to access the house to take picture all that, however, the tenant kept evading us such as not picking up phone call, not replying our whatsapp, even if reply also claimed outstation ... so we can't get access to the house.

In this case, what shall I do? I am very lost here. sweat.gif

Perhaps tenant are not comfy over the prospect that the ownership will eventually change hand, is the buyer gonna buy for own stay or investment if the latter then you can check if they wish to continue the tenancy that will likely make tenant more open to the idea of viewing. If it’s own stay then you can quote the clause in tenancy agreement which allow landlord to view the unit with advance notice, hopefully it’s not because tenant had some hanky panky in the unit thus not allowing viewing.

When a landlord wants to sell a tenanted property, he should give the FIRST option to the tenant to purchase. Only when the tenant declined, then only sell it in the open market.

Secondly, some tenants are not aware that they can cont to stay after the property is sold when the tenancy hasnt expires. Is the duty of the landlord to explain to the tenant.

As landlord, you should deal with the tenant for the first time instead of leaving it to the agent. Ask the agent to meet at the property, Intro the agent to the tenant and take whatever photos required. Thereafter the agent can follow-up with the tenant for future viewing.

If landlord has taken the approach of discussing with the tenant ahead, most tenants wouldnt have the above issue and will co-operate.

Been to same situation as the tenant... some time it is just uncomfortable having strangers coming into you home and taking photos.

Unavoidable and need to be considerate also as ultimately it’s rental unit and not own although you paid rental, that why mutual understanding require

Yes this is a good approach. I sold my first home to the tenant.

If the landlord has initiate the first move, most tenant will normally agreed.

Landlord is the owner, but the person opening the door is the tenant !

If tenant is adamant not to cooperate, landlord has no choice but to wait for the TA to expires and give notice to vacate.

In any dealings, the first approach will determine the ending.

maybe u need to pay them a visit and telling them story like your parents are aging and really need some cashflow for medical reason. also, probable offer them free one month rental if the house is successfully sold. give them some carrot lo

Not really, TA will have clause to allow landlord or authorized person to enter the unit with advance notice

When I told my 4.5 years tenant that I want to try to sell my condo, then she no longer update me when she made monthly payment.
She used to send me payment slip. tongue.gif

One of the way you can do is to politely approach your tenant see if they would like to buy.
They usually will know what it means already when landlord asked if they want to buy the house. That is one way of telling them you are selling your house, and you gave them the priority first before putting on market.

since you selling, can just end the telant contract when it expire.
then you free to take photo or watever after they move out.
