 renew tenant lease need new agreement?

Just extend a formal letter to the Tenant & state all the terms and condition remained the same, only the duration of the tenure have been extended. This letter both owner & tenant need go sign ( like the last page of the tenancy agreement ).

The stamping, just ignore it for now. Reason - the penalty for late stamping is very small amount. If anything were to happen, you can back stamp the tenancy agreement with penalty & it is still admissible to the court.

Let me get this straight.... You're saying that to back stamp the agreement will have to pay the stamping fee as well as a penalty, but the penalty is very small (how small?)

Why not just stamp it now and do things the proper way?

PENALTY

An instrument may be stamped within 30 days of its execution if executed within Malaysia or within 30 days after it has been first received in Malaysia, if it has been executed outside Malaysia.

If it is not stamped within the period stipulated, a penalty of

RM25.00 or 5% of the deficient duty, whichever is the greater, if stamped within 3 months after the time for stamping;
RM50.00 or 10% of the deficient duty, whichever is the greater, if stamped after 3 months but not later than 6 months after the time for stamping;
RM100.00 or 20% of the deficient duty, whichever is the greater, if stamped after 6 months from the time for stamping; may be imposed.

The above rates are effective from 1/1/2003

Some ppl just dont have time , some ppl just want to procastinate , some try to avoid record in LDHN 🫢, some just want to save the little money, etc

But one thing for sure, it can be stamp back dated with penalty.

And this, ladies and gentlemen, is one of the reasons why M'sia is so effed up. Always trying to game the system.
Should the day come when that stamping is needed and penalty is imposed, non stop will cry zalim/kasi chan la/tertindas/hal kecil sahaja
