 Guidelines for US visa

Hello. Can i check how yo work in US? There is a us company who is keen to hire me but seems like they need to talk to a legal immigration specialist as it is out of their expertise to hire foreigner. My question is, is it difficult to get the working visa? I googled seems like HB-1 is the one to go? Or am i missing anything? Is the visa quota full ? Thanks.

What it has anything to do with Malaysia? It is whether your application to get the visa from US embassy get approved.

Last time Trump already stopped taking foreign labor but Biden I have no idea.

Do you plan to get their Green Card after some time? If yes, then H1-B is not the route for you. Find other visas.

H1-B is a bit restrictive and expires fast.

But is it lottery based ? How long is the processing time if u dont mind explaining ?

No it’s not lottery, but you’ll need your employer to apply for you in the US. In addition, you also need to attend visa interview at the Embassy in Malaysia

Not sure if you have more details available from the company wanting to hire you as so far from what you have provided seems 'light' for a serious offer.

What i'm typing below is based upon my assumption that you're currently based in Malaysia and planning to work for an unrelated company, ie. not a transfer.

1) US companies typically do not apply on their own but rather outsource it to a Law firm and an attorney/paralegal will be assigned to your case.

2) They'll work with you to gather all the required documents.

3) Using my assumptions above, the likely path you'll be taking is the H1-B visa. This visa has a yearly cap and is usually over subscribed leading to a lottery situation, usually the chances are 1 in 3.

4) Timeline is usually around April submission for the new fiscal year. Best to google this for the upcoming FY2023.

5) If you get selected in the lottery, the lawyers will send you the paperwork and you'll then go to the US embassy in Malaysia for the actual visa itself.

6) Once visa is obtained, fly to the US to begin your new job

you mean from the time of online application?

cannot leh... because the date of interview appointment itself will already be few weeks later, then you need to wait a week to collect back the passport.
unless you get very lucky and find an interview slot in the same week you apply online
