 Security Deposit refund

hi guys,

anyone having experience with the refund process from developer? (Tropicana).

I put in deposit to book the property on 18 Apr 2021, the deposit was put into developer's account, agent said deposit is refundable, after 3 days I decided not to pursue the deal and ask for refund.

after 4 months I've still yet to receive the refund. Agent's excuse was quote

"For refund part, All payments are from HDA account, developer need send to bank check and verified, then cheque also collect from bank side. Now FMCO, not only developer side slow due to WFH, bank side also delay on the process."

so anyone also getting the same experience on refunds? Thanks

In any cases, is never easy to request for refund. Make sure you know what you are buying before parting with a deposit.

Keep following up, unless you want to use legal means.

Btw, what is the tnc in the form you signed regarding refund ?

on the booking form there is a column that says 100% returns but i doubt it's a refund.

there is one line in the T&C that mentions refund.

"In the event of cancelation/termination/abortion of the SPA for any reason whatsoever, this sales package shall cease immediately and become null and void and we shall reserve our right to claim reimbursement for any costs and expenses that we may have incurred or suffered including but not limited to any fees and disbursements paid by us and you hereby acknowledge and agree to us deducting the aforesaid costs and expenses from any monies which are to be refunded to you under the SPA."

they did not mention deducting any costs or expenses, they did acknowledge that they'll be doing a refund. but it is taking pretty long (almost 4 months). I've been asking for updates once a month and still getting the same reply.

don't think it's worth taking legal action for a small amount but certainly feels like i'm getting the short end of the stick. I should've known not to be easily persuaded by the sales agent if I know it will be such a hassle to get a refund. lesson learnt i guess.

The minus cost part is questionable but you have no choice to agree to the deductions. Hopefully is not a big sum.

Just follow up every few days.
